Indeed, but no different to the scenario in the St Helens piece I linked to earlier - GPs won't want the ultimate responsibility of declaring a driver 'fit and proper', but obviously LAs would prefer they did, thus trying to avoid the blame if it all goes pear-shaped, Glasgow bin lorry-style. But ultimately, as things stand, legally the onus is on LAs to decide fit and proper status. And to be fair to the Scottish Parliament (for a change) I doubt if the scenario overall up here is a whole lot different south of the border, as indeed the St Helens article demonstrates: viewtopic.php?f=2&t=34516&p=391709 |

As no-one can predict what MIGHT happen, whats the point? 100% fit lean non-smokers non-drinking folk have heart attacks and strokes |

(As opposed the current legal requirement of 20 metres.) By the same token, bus and HGV drivers (and most cabbies) are held to a higher standard because they're deemed a higher risk because of the job they do. And older drivers considered higher risk as well, which doesn't seem unreasonable - everyone's driving ability deteriorates with age - it's just a question of assessing that risk in a reasonable manner. But no system will ever be foolproof, as today's news article from Edinburgh arguably demonstrates. |
