If a LA pass new (higher) meter rates, is a hackney obliged to have the meter updated?

I have one only doing schools, or prebooked out of area (i.e. big) jobs

The LA have said we must update meters "as soon as possible".......wishy washee

Your meter must be calibrated to the current rate.

If at all times it is at a lower rate than the Tariff set, it is probably OK.

But doesn't the meter have to display the correct fare?

The fare on the meter must match the Council set rate as on the TARIFF TABLE that has to be on display in the vehicle, you may have an additional Tariff on the meter as long as it is less than the Council set rate, you are not allowed a higher rate under any circumstances.

But you are allowed a lower one.

Yes,but the current Council agreed Tariff must be on the meter also, the Tariff table on display in the vehicle must also have the current agreed Tariff on it.

Does anyone know where it actually states this? I can’t seem to find the legislation anywhere (we’ve just had a meter rise and a few of the drivers are refusing to have their meters updated.)

you are always able to charge under the metered rate but the correct must be shown, we just had a fare increase all meters were to be updated by 1st November, the same happens every time we have a tariff change a few weeks after the local authority arranges a day where all drivers are required to attend a location where a licensing officer will be present in the taxi to check the measured mile, if your la dont this check with meter agents if they send info of vehicle license plate that's been updated or not,

It should be in your licensing policy.

up here your meter MUST be set to the current tarrif
when a rise is implemented you get until about 2 weeks later to get it set and calibration checked by the council and your meter sealed by them, and if you havent got your meter done they will suspend your licence and tell you to hand in your plates,if you dont enforcement will even turn up at your door and remove your plates from the vehicle

This kind of stuff won't be found in legislation, it should be laid out in the council's bylaws/licensing conditions.

Well, I can’t find it anywhere in our licensing policy (or bylaws) the only mention of the taximeter is as follows}

2.6 When driving a hackney carriage vehicle fitted with a taximeter:
(i) the driver shall ensure that when the vehicle is on not hired, the device is kept inactive.
(ii) the driver shall ensure that the table of fares is not concealed from view or rendered illegible.
(iii) the driver shall ensure that the taxi meter is used for all journeys and is engaged only at the commencement of a journey once passengers have boarded the vehicle.
(iv) drivers shall ensure that the taximeter is used at all times when undertaking journeys within the controlled district.
(v) at no time shall the driver charge more than is shown on the meter.

Might be an idea to email licensing asking them to clarify the rules.

Also requesting they point out where those rules have been agreed by councillors.

I’m loving our new meter rates. I’ve always suspected my meter was slightly under clocking, especially when I fitted larger wheels (17’ instead of 16’, although they were lower profile which helped to reduce the difference) I had it checked on a measured mile and it was 5% out. It has been recalibrated and, together with the 10% rise, I’m very happy. :D
