Post subject:  Hypothetically speaking...

Would you be happy if you discovered your licensing dept granted a plate or badge on deferred terms (pay later) as the applicant was a "bit short" this month...?

would it be legal?

I think it would be legal, as the license has been granted to a fit and proper person (or vehicle).

I also say well done to the LO for using their common sense in issuing the license to someone currently down on their luck financially.

Licensing arent supposed to make a profit, so my fees are being used to subsidise a 3rd party?

If they cannot afford 1 fee can they maintain a vehicle?

I had a heart attack last year and lost £2000 in 4 weeks being off work but i didnt seek a handout

If they get 1 legup what happens next time?

But it's not a free plate if payment is merely deferred?

More like a loan, effectively.

Suspect someone's knuckles might get rapped if a complaint was made, but doubt it would come to much, and if I was the complainant I'd worry about it coming back to bite me on the bum.

Certainly something worth recalling in future if a bit of minor rule-bending is required, though 8-[

A Council must charge the prescribed fee for a hackney carriage or its driver license but can set aside the fee for a private hire vehicle or its driver according to the Act.

As things are going I think all councils will have to be flexible with payments

I've been in contact directly with the financial folks at our council and I'm 100% they are open to help the trade in as many ways as they can.

I truly believe that central government is open to finance things to keep folks in work, and off the dole.

Re the illegal state aid thing under EU law, just thinking that Wanna's council's licence payment deferral might have technically fallen foul of that particular provision.

Of course, chances of it ever ending up in the European courts were zero, and certainly won't be happening now.

And, as Edders and Sussex saying, likely to be a lot of this kind of thing in future.

Our Council have given us permission to divert the phone to a driver to take bookings if we have to shut the office.

I'm hoping many other councils offer a high degree of flexibility, as no-one with any brains/common sense is going to object to rules being bended in an attempt to keep the trade afloat.
