If the Council say that they have suspended a drivers badge temporarily do they have to give a written reason as to why they have suspended it? Can they suspend with immediate effect or does the driver have the right of appeal? |

Can they suspend with immediate effect or does the driver have the right of appeal? They have to give reasons as to what they are suspending for, and tell the driver that he has 21 days to appeal. Unless the suspension is 'in the interest of public safety', or words to that effect, the suspension will only start at the end of those 21 days. Unless the driver appeals and then the suspension will be suspended until the outcome of that appeal. The words I have highlighted are very important. All that said the council is getting themselves in a little bit of a pickle, by suspending temporarily rather than revoking. Thought they could not suspend and then revoke, they had to do one or the other, suspension could not lead to revocation. |

This is why I think they made an error by initially suspending. TBH I didn't think any council did that nowadays. Suspension is a punishment, not, IMO, an interim measure. |

Just in case anyone reads this thread in the future, all the above doesn't really apply if the suspension is on medical grounds. Being ill is not something you should be punished for by licensing officers. |
