Dear all members of the forum community

Hope all is well with you members. So I had my taxi badge revoked for 5 years for a CU80 offence in March 2023. The council had informed me that we take mobile phone very seriously as it is a very serious offence and we cannot take any mitigating circumstances but yet in November 2023 council had granted a renewal on a driver for a CU80 offence due to he had mitigating circumstances as they call it consent order appeal.

Any ideas to what I can do and who shall I speak to?

Surely the rule applies to everyone that commits a CU80 offence?

We have over 350 different councils with over 350 different sets of rules, but I suppose the question you are asking is should all drivers be treated equally, and the answer is yes.

Does the council have a set of rules and regulations, do those rules and regulations specifically state that offence leads to a 5-year ban? Did you, at the time, appeal to anyone about the severity of the punishment?

I would write to the Chair of Licensing about your concerns i.e. you have not been treated in the same manner as the recent case. Depending on his reply you could contact the Ombudsman.

It's too late to go to court, so don't threaten this that and the other, just point out in a reasonable manner that you don't believe you have been treated as fairly as the driver in the recent case.

Another case of double jeopardy, you get doe at magistrates for the CU80 using a mobile device, then the council ban you for 5 years. Same thing can happen with bus and lorry drivers, they get an invite to a public inquiry with the the local Traffic Commissioner who can then revoke or suspend their vocational entitlement for a period of time. Maybe you should make an appeal to the magistrates under the existing laws.

as sussex pointed out he's a bit late for that.

Just out of interest which licensing authority are we talking about here ?
