MINUTE of LICENSING COMMITTEE
Minute of Meeting held at 10.00am in the Council Chamber, Council Headquarters, Giffnock on 22 September 2005.

Present: Councillor Ian Pearce (Chair) Councillor Danny Devlin (Vice Chair) Councillor Iain Drysdale Councillor Allan Steele Councillor Pearce in the Chair

ALLOCATION OF TAXI LICENCES

1328. There was submitted report by the Director of Central Services, a copy of which had been issued previously to each Member, regarding proposals to allocate a number of taxi licences that had been returned to the Council.
Having explained that there were 77 taxi operator’s licences in East Renfrewshire and set out the background to how this figure had been reached, the report explained that recently, 5 licences had been returned to the Council.
The report provided details of two methods for issuing the licences, namely using the waiting list that had been inherited from the former Eastwood District Council, or by way of public advertisement in the local press. The report set out the advantages and disadvantages of each approach, and recommended, on balance, that the waiting list be used to allocate the licences.
In addition, the report recommended that in the event the Committee agreed to use the waiting list to allocate the licences and there were still some names on the waiting list once the licences had been allocated, the list be abandoned and any licences that were returned to the Council in future be advertised in the local press.
Speaking in amplification of the report, the principal Committee Services Officer highlighted that the 5 licences had been returned to the Council by one company, and in order to reduce the possibility of multiple licences being held by a single individual or company in future, suggested that if licences became available, that existing licence holders be excluded from applying.

The Committee:-
(a) noted that 5 taxi licences had been returned to the Council;
(b) agreed to use the waiting list from the former Eastwood district Council as a basis for the allocation of the licences;
(c) agreed that once the licences had been allocated, the waiting list be
abandoned and any licences which become available in future be advertised in the local press; and
(d) agreed that any existing licence holders be excluded from applying for any licences that become available.



Resolution (d) looks of dubious legality to me [-X
