They say convictions can no longer be spent when applying for a licence, and that they will use their descresion when assesing a aplication, is this now true. |

Read the "Guidance" Leaflet that comes with the CRB / Disclosure Scotland form or look at either website. In signing the form requesting the check you are agreeing to your rights under the Rehabilitation Act to be waived. Checks will also be made with other Services to ensure a person is fit and proper; ie. not on the sex offenders register, forbidden to work with children etc. If this weren't in place someone who committed a crime over 3 years ago (except if sentenced to more than 30 months imprisonment as these are never spent) could be out working an no one would ever know! People do get less than 30 months for manslaughter

Correct, but I bet your council hasn't got a policy, written down that has been passed by councillors, that says in detail what's acceptable and what's not. And courts like it written down, not subject to the whim of a LO.

Begs the question, 'are councillors fit & proper ?' How about criminal record checks published in the press at election time ? |

Under the Rehabilitation Of Offenders Act 1974 (Exceptions) (Amendment) Order 2002, the Council can take into account 'spent' convictions as drivers are not exempt under the Rehabilitation Of Offenders Act 1974. Also Cautions are never ‘spent’ and will be taken into consideration even if the Order of 2002 has not been adopted. As a previous 'poster' has stated, if you haven't anything to worry about why worry? |
