talking to one of the drivers who has a nice well paid school run

today he was pulled up at the school after the kids got out, hey who's that in the child seat
He has an escort for the job, his daughter, who brings along the small child who is put in a child seat
The school aren't very happy about this and are taking further advice

he states that he is covered for the school kids on the hire and reward insurance side, his grandchild he is saying are covered for insurance by social domestic and pleasure insurance side. He is stating it is his vehicle so he can carry both the school kids and his grandchild for the run out to the school

would this be right, can this be right.??

Let me further add that he is a subcontractor for the education area, to which the main school contract is held by another firm

I think you might find that the education contract will only allow you to carry the paid escort if there is one and the children you are contracted to carry. If the escort is part of the contract then there is no problem with that but there would be a problem with anyone being carried who wasn't authorised?

Besides the contractual terms of the agreement, under hackney carriage legislation unless agreed it is an offence to carry anyone other than the person hiring the cab. I'm afraid if anyone doesn't have permission from the hirer, then technically an offence has been committed.

59 Penalty for permitting persons to ride without consent of hirer Any proprietor or driver of any such hackney carriage which is hired who permits or suffers any person to be carried in or upon or about such hackney carriage during such hire, without the express consent of the person hiring the same, shall be liable to a penalty not exceeding [level 1 on the standard scale].

Insurance shouldn't be an issue but I wouldn't be surprised if the education authority told the contractor that they can no longer take their young child. They may even cancel the contract.

is this just for Hacks. Is their anything about PH drivers doing the same job who's escorts take along their own kids on the school contract job

with private hire i think it will be the same ie only allowed to carry the people who are on the contract ,there could also be an issue with sub contracting the contract

I gave the driver the details, he says he's only trying to fill seats, I explained, you are not an aeroplane

his thoughts are he only gives 2 seats up in his vehicle to the Educational contract, he believes he can use those other seats for what he wants, he's got the paper work re the law, its now up to him

lol I'm afraid the item that is being hired is the "whole cab" not just "one" or "two" seats? If that was the case he should operate as a bus, at seperate fares.

I think common sense should tell you not to have people along for the ride. What if that seat were needed one day?.
