I got a phone call at 2.15pm today, The LO asked if i was with an operator yet, i said no, so he said he was suspending my vehicle.
I explained that i've removed my plates (as he asked 2 weeks ago) and he said it doesnt matter you cant have a licenced PH vehicle unless your with an operator.
Now does this mean i now dont have an MOT? because obviously my compliance certificate is suspended as well?
My insurance is sd &p as well as PH, but will this now be void as well?

When i asked him to enclose a copy of the relevent law he was quoting to me he said you'll have to find it yourself!
As the suspension will be by letter, i cant appeal until i have it in my hand (so he tell's me).

HELP!!!!

I think your insurance should be OK, but check with them anyway, do you have a ordinarily MoT and compliance test, or just a compliance test. we have compliance test only which overrides the MoT certificate, but I always get them to give me a MoT certificate as well it usually costs a fiver. I think what we would do here is simply hand the plates in and asked them to keep them until you're ready to go back on the road.

He cant suspend you until you have the official letter. See what it says and we'll take it from there, if you wish, you can appeal, which will give you the right to do what you want until the appeal is heard.

Unless you have been given special dispensation to take your plates off, they should remain on the vehicle.

There is case law on this on TDO. I'll try and find it.

I think the licensing officer is taking the approach that once the vehicle is Licence as a private hire vehicle, it is always a private hire vehicle so therefore should be attached to a radio company, there is a case on this is the not JD.

While its licence is in force that is

Cheers JD, i said i want to appeal and he said i cant until i get the letter, so i will.
Ive just heard that (allegedly) he suspended a driver then threatened to report him for driving without an MOT, i wouldnt know if this was true or not.

Mr T, no i havent got an ordinary MOT (yet) but i will tomorrow :wink:

He's just showing his true colours, last week he told me to remove my plates (in front of witnesses) and it'd be ok, today he suspends me.

I'm not on a system at the moment so i cant display door signs.
But the reason i havent suspended my plate is, if i want to work for instance on saturday night, i can ring an operator and be on the road in 1/2 hour, but if my licence is suspended i cant, so surely this is against my right to work and earn a living as a self employed person?

You are on a system, your just on holiday, whether it be one day a week or the full week does not matter , do your conditions say that you must display your door signs at all times

No, they say door signs must be displayed. (not at all times)

I dont have a problem with displaying at all times IF thats what the rules state, but they dont.

I'd like to see where it says A PH vehicle MUST be assigned to an operator AT ALL TIMES as well.
As ive said, if he suspends me and i want to work one weekend i cant because he needs to unsuspend me!
I took my plates off as he told me to (now after reading JD's post that was illegal!).

I was thinking of that, but he if he doesn't want the door signs on it defeats the object
