I think there's also an old offence of furious cycling, but I doubt if it's been enforced once since it was introduced.
Dunno what the limit was, but if he was doing 80 in a built-up area then it's difficult to feel any sympathy. |

I wonder if BMW x5's forcing left turning taxis to do an emergency stop could be charged with that !
What would the evidence criteria be ? |

I assume it was because they weren't sure they could get a conviction. The Procurator Fiscal (or CPS down your way) may go for a lesser chance if they are more sure of securing a conviction. A few weeks ago there was a case in Dundee where a young driver was doing nearly 80mph in a 40mph zone, and he was done for careless driving. Presumably he was charged with this to ensure he was convicted, but in my eyes I don't see how you can carelessly get up to twice the limit, but on the other hand I suppose that's not to say he was driving dangerously either since I think it was late at night. |
