A very recent case in the High Court established that a contractual agreement over the telephone is binding. The implications for those involved in Radio work is therefore plain for everyone to see. If you are a Radio operator be careful what you say when taking bookings in respect of giving price quotes or any other sort of quote and make sure any reference is not binding on the driver of the vehicle sent on such a job or the company itself.

This case also reinforces the contract terms of Drivers who negotiate a fare which is not on the meter. Again CCTV is a boon in such circumstances because it will record the contractual agreement between both driver and passenger.

You should leave the passenger in no doubt of what the fare will be and as per usual if you are traveling a substantial distance you might wish to get your money upfront if you feel there might be a problem at the other end.

A verbal contract is binding here also, the telephone case just reaffirms the law regarding telephone conversations and financial redress should such a contract not be honoured by either party? Therefore if you go to an address on time and they are not there and it leaves you substantially out of pocket then this case makes it a dam sight easier for you to obtain financial redress. The same applies if a punter books a cab and it fails to turn up. Regards JD
