The car is insured by the driver and owned by the driver yet the private hire license is in the name of a third party the council have took the plate away on the grounds that the license is not in his name is this right or wrong |

If the licence is being used for the benefit of someone other than the licensee - which it clearly is in this case - then I think the council is right. This arrangement has been quite common over the years in Scotland, but they're a bit cleverer up here (or dafter, depending on how you look at it) because all the paperwork is in the name of the licensee. The reason this has been so common up here is because Hackney plates can't be transferred, but if PH plates are available on demand then why is this happening in your neck of the woods tcabbie? |

the reason the driver buys a car pays the insurance then gets a plate in another name is? thats what the court will ask if he challenges the council ruling,many of the dundee hired plates were caught out because of this nonsense |

The plate/vehicle license should be in the name of the owner. If that's why they have taken away the plate, then they are doing it within the law.

The licence is for the vehicle... the licence is only valid as long as the car is licensed.... the licence can only be in the name of the registered vehicle owner,....but you can have more than one name on the licence.... ie.. Bill Smith.. Joan Smith..... Bill Smith is the registered owner of the vehicle..... insurance bill Smith.... nominated driver Joan Smith.. or excluded from driving Joan Smith.... |
