Post subject:  wheelchair lady
on our rank we have a woman that uses us regularly but she really has a hygiene problem in fact three of the drivers have been physically sick when we approached the licensing committee and asked if we could refuse her on the grounds of how bad she was they said no and we could get our license revoked has any body come across this before

The driver of a taxi shall not knowingly allow the taxi in his charge to be used for
illegal or immoral purposes or permit to be carried in the taxi in his charge any
article of a dirty, filthy, noxious, explosive or dangerous nature, or permit to be
carried in the taxi in his charge any person who has vermin on his person.


The driver of a taxi need not convey any hirer or passenger who is drunk or
otherwise not in a fit and proper state to be carried, or whose condition or clothing
is offensive or likely to cause damage to the interior of the taxi, or is accompanied
by any animal (other than stated in Condition 10a below) which is likely to
damage or soil the interior of the taxi, or for any other reasonable excuse.

The best relevant paragraphs that might help is;

8. Picking up passengers

A driver should not refuse to provide a service for a person
on discovering, or because they already know, that he or she
is disabled. If a driver refuses to carry a disabled passenger,
who would otherwise be able to use his or her vehicle,
having either stopped as a result of being hailed, or been
approached at a rank, then it is likely that this would amount
to unlawful discrimination.

However, this does not mean that a driver should carry a
disabled passenger under all circumstances. If the disabled
person is drunk and abusive, for example, a driver could
refuse to carry them just as they would a non-disabled
person in the same condition.

Don't you have a few valid reasons for refusal in your conditions? We do. This one would cover it.

16. you could wear a breathing mask and a pair of surgical rubber gloves as you load her in, keep the mask on whilst driving, every now and again spray the air freshner around in large squirts and put all windows down whilst on the move, they will soon get the hint

If you have a reasonable reason you can refuse anyone you like.

Now the question is is being old smelly a reasonable excuse to refuse. If it has made some drivers ill, even if for only a short time, and/or it has left a smell which has effected other passengers, then I think telling the smelly old cow to pi** off is entirely justified. :wink:

The fact that your licensing team has threatened to remove your license surprises me not a jot. :sad:

Spot on - it also applies to anyone that you see as a threat to your health and well being , you know the type swaggering down the street and when they get into your cab they will perform - a very big NO. If those drivers are being made to feel physically unwell then that could affect their ability to drive safely, now they do not care about you and I - but if it affects the safety of the passenger as it clearly would, Well............ what can I say, I suppose NO.

Im sure that if If the lady regularily soils Vehicles any driver would have the right to refuse her as a fare, its not the disabilty they are refusing (im sure not a single driver would refuse on Disability grounds) but the Health Implications to other users as the lady could pass an A myriad of diseases to the next Vehicle Occupants, this has no Baring on her Disability but on her low level of hygiene just as an able person would be refused on the same grounds.

If we were to be Hauled over for refusing anyone in a wheelchair it would leave the door open for, Knife weilders, Gun carriers, Suicide Bombers to hop in a Wheelchair and say to the Driver "Look here Mate, You have to Take me or else the wrath of the Council will come Crashing down on you"

no...its the passenger being refused in this case and not the Disabilty...and thats Perfectly fair.

If she can't take care of her personal hygiene, she should have someone who does it for her.
My Mother had MS for years and she wouldn't have dreamed of going out in a state like that.
I don't mean to come across as uncaring but how much is a cabby supposed to put up with?

Disabled or not..If the person in question is Potential Health Issue to other users of the Vehicle it should be at the drivers Discretion as to whether its acceptable or not to take her as a hire. all that Disabilty awareness type Groups ask is that people with disabilities are Treated as equals and along with that equality comes the responsiblity to accept the same rules as the more abled bodied adhere to. if the lady is unfit to to travel through her inabilty to attain a reasonable level of personal hygiene , God knows she may spread Typhus or any Number of Contageous diseases through her faecus that I suggest she should be using the NHS Ambulances or some Specialist Voluntary Transport group that can Handle the More severely Issued, especiallly the Incontinent and those with little or no bowel control. Even Hospitals handling people with these issues would have special beds and specialist units and staff on hand to assist with their extra needs, they also have the Right to refuse Treatment if their is a risk to others Especially there Staff.

It would be unfair for any Taxi to be forced to carry such a person that after a £5.00 fare would need a New Seat or the vehicle professionally Hygenically Cleaned after each journey...considering they Dont get Charitable Contributions such as the Mobilty wheels type people do.

I reckon the council that Says they Could revoke a licence for Not accepting this Individual are Likely to lose the argument in a case of an appeal if it was proved that her Lack of Hygeine (be it her Own fault or Not) would be Detrimental to the Health of the General Public and all other Vehicle users because it would Contravene the Public health act.
