1. Can a licensed PH operator pass work on to any ph driver licensed by the same LA (driver and car) who might not work from the same office. 2. Can a licensed PH operator pass work on to a HC driver licensed in the same LA. |

You will of course be aware of the Wrexham Magistrates court decision which precluded that a licensed private hire operator in Wrexham could not pass on work to a hackney carriage driver licensed in Oswestry. However it was precluded that the licensed Oswestry hackney carriage driver could independently operate in Wrexham as private hire. The decision in the minds of many suggests that the mind of the person giving the judgement was somewhat confused as to the law as was expressed in Gladen. However one hopes that the law will be clarified on the 15th of next month and then we can all have peace of mind. Regards JD |

The blunt answer is no.... An operator can only pass work on to the vehicles under his licence because there is some level of liability to the driver & vehicle being insuranced and licenced. Obviously you have to monitor your own fleet but not others... However, you can pass bookings on to the other company who can then pass it to the driver....... I know that sometimes, that's just not practical and that corner gets cut.. But, I wouldn't Oh NO NO NO .. not me officer..... |

If an operator can't clear a job for whatever reason he/she can pass that work to another licensed operator in the same area. Happens 1000s of times a day. |
