A vehicle that has the capacity to carry 12 passengers if the operator declares that he will only be carrying 8 passengers?

They can only license it if it has 8 or fewer passenger seats.

It might have the capacity to seat 100, but it must only have 8 or fewer passenger seats.

What if the seats are not clearly defined as in bench seats? There is no upper width size for seats.
The reason I ask is that one of my limo mates has bought a large suv type limo that clearly has a seating capacity of at least 12 passengers but his LO has given the vehicle PH plates for 8 passengers and was happy to do so. I have absolutly no doubt that this operator will only ever carry 8 passengers and not one more but could he still have a problem if he gets a tug from VOSA etc. Or because he has plates can he tell VOSA that it is none of their business.

btw, VOSA can pull anyone, not just PCV/HGV....PSV/LGV, whetever...

It could be both PCV and PH..if the Extra seats are removed when it resorts back tp PH and youve got a special Extra use class on your PCV permit/Licence. dunno if it'd be easy finding an insurance cove to both uses though.

The seats are not removable. The seat belts, I presume will be removed so that there are only 8 in the car. But don't forget that there is no legal requirement to have seat belts on side facing and rear facing seats.

they may or may not, but they would call in The Construction and Use rules...its always the fine print that gets you

I think the number of seat-belts is then counted.

Also I think there is a minimum size area for each customer, but I can't remember what it is.

No council will license a vehicle without the required number of seat belts.

400mm or 16 inches in old money, measured across the front of the seat, if my memory is still working OK.

No not at all. This is one of the good guys who has been licensed for years. He never has and never will carry over 8 passengers. I am just concerned that he could fall foul of something because the vehicle could carry more passengers.

Is the self drive facing problems?

they usually insist that you take the extra seats out
