If I fit a meter in a PH, at the same tariff as a hack in my LA, will the LO want to charge me the same to check the meter as they do with a hack, PH's dont require meters here

i asked the LO and they never got back to me "weve never been asked that before............."

If you fit a meter I would think that the LA will want to check that the tariff stated is correct and therfore they will charge you for the check.

Here's one ; If a PH sets their charges at a lower rate than the councils and then overcharges a customer on their rates but not greater than the councils, have they commited any offence ?

eg. Council fare would be £10, PH rate would be £5, they charge £7. Still under the council rate but more than the PH advertised rate. I don't mean by charging more than what's displayed on the meter but by taking a longer route so the displayed rates higher.

Yes, you set your own rates but if you are using the meter the council will need to check that your meter is set to the rates that you specify.

If you have a meter the council can check the rate you are charging is the rate on the meter.

In Hackney regs...........

Quote:
24.0 Taximeters
24.1 All hackney carriages shall be fitted with a taximeter of a type approved by the Council.
24.2 The meter shall be capable of displaying the various tariffs as approved by the Council, including extra charges recoverable under the approved table of fares.
24.3 The meter shall be located within the vehicle in such a position that any fares and charges are visible to persons traveling in the vehicle.
24.4 The taximeter shall be calibrated to the Council agreed tariffs currently in force and sealed with an official Lichfield District Council seal by a person authorised by the Council to seal taximeters. The taximeter must be sealed in such a way that the calibration of the meter cannot be tampered with.
24.5 The taximeter fitted to the vehicle shall be subject to testing on demand to be carried out by the Council, to ensure that it is calibrated to the fare table currently in force at the time.
24.6 Any Council seal which is tampered with, without good reason, will render the licence holder and vehicle liable to formal action by the Council.
24.7 The taximeter must be used for all fares taken and the maximum fare charged is that displayed on the meter.
24.8 For the avoidance of doubt, nothing in the above condition shall prevent or prohibit a driver charging less than the prescribed fare (which is intended as a maximum fare only). The meter must not be started until the hirer is sat in the vehicle and must be operated for the entire journey.

But as there is a charge for meter testing on the fees for Hackney vehicles but not in the Private Hire fees how would they charge me?

24.7 states that the meter must be used on all fares. Does that include fares that go out of the district?
Also this set of rules is obviously for hackney carriages. Where is the set of rules for private hire regarding fares?

There arent any

Which is why I cant see why or how they can check a meter in a PH

I was looking at joining a circuit which has hacks anyway so would get a meter for uniformity

Are you saying that in the private hire conditions, there is no mention of fares at all? Not even to say that they are negotiable between the office and the customer?

Accuracy of meter even if you set your own rates you still have to have the calibration of your meter checked

Correctomundo, neither in the vehicle licence requirements nor the ops licence, only in the hackney regs
