At the permission stage different costs apply for a written application and an oral hearing. For oral, you are looking at two thousand five hundred pounds for the winning party, plus your own costs. I suspect the exercise would have cost in the region of at least five grand. A full case would have cost in the region of 20 - 30 grand depending on the complexity of the case?

According to the radio the Association have to pay costs (I'm guessing the councils) of £10,000 :shock: , on top of what they paid the barrister (a figure of more than £10k has been said for that). Whoooops!!

If I was in their shoes I think I would have fought this case, but as I'm on the other side of the argument I'm glad they lost.

I suppose it makes sense....a council can change a policy despite leading people to believe they have a structured system in place and they are accountable to nobody... :shock:

The above aside, were the local association members of a National Body or Union?

They did fight it but the application was refused, the only alternative would have been to apeal the failed application. The judge obviously told these guys exactly what we told them, that their application was unfounded and the councils decision was not only lawful but was arrived at in a perfectly lawful way.

Another hard learned lesson for taxi drivers.

I don't think a judge would be the least bit interested as to whether they were or not, when arriving at his decision!

The local association were always shovelling sand uphill & getting wet pi**ing in the wind on this one.

I think the "fighting fund" came from the refund of the survey fees from the Council, a figure of £250 each was mentioned somewhere.
