Listen closely. You are being investigated & you are suspended for something you have allegedly done. They have some complaint made by a third party, & they deem the complaint worthy of a suspension. I suspect you know exactly what the complaint is. If you don't you should find out! I would want to know if it were me. But you already know that don't you.

Ouch you've dropped a big one there mate, when the Council said they were going to suspend you you should have said right I'm going to appeal against your decision, they have to give you your badge back while the appeal is going through, if your appeal fails at the Council take it to the Magistrates Court, in the meantime your allowed to drive while your appeal is going through.

Our lot tried suspending me back in 1993 I did the above and won.

The Road Safety Act 2006 contained three taxi/PHV measures. The first one - allowing licensing authorities to suspend or revoke a taxi driver's licence with immediate effect - came into force in March 2007.

I think it was Feb 2008, but you make a good point.

That said the new act only stopped an automatic right to work up until a court said otherwise, now should a council suspend till a court hearing it's open to the driver to ask the court to overturn the councils decision.

Council can now suspend a licences even if you or to appeal, if they think you are a danger to the public.

that would mean that you could not drive until the out come of the appeal. unlike before you could continue to drive while you were waiting for your appeal.

Councils can only suspend up to the date a court says otherwise, and that could be the following day, not necessarily the day of the court case.

The Council cannot suspend you only if you've been charged with an offence which like you say puts people in danger, being out on bail does not put you in the catagory of being dangerous. When you've been charged with an offence thats when the council can take your badge away.
