today I heard of two licensed taxi drivers being "done" for not wearing seat belts whilst plying for trade in and around Falkirk. (I believe there may have been others). I phoned my LO, on behalf of one of them, for advice,and he didn't have a definitive answer to hand. So in the interests of clarification I searched the web and found this:

Whilst taxi drivers are exempt from wearing seat belts while on duty (whether they have a passenger or not), Private Hire taxi drivers are only exempt when carrying a fare-paying passenger.

cue two very relieved (and not of £60) drivers, and I suspect two rather embarrassed officers of Her Maj's finest, as both tickets were revoked.
