Who is going to deal with taxi drivers who continue to use their taxis after they have been issued with a PG9? Would it be VOSA, the LO or both? What penalty's could be imposed?

Our LA conducted a vehicle inspection with VOSA last week and I have been told that 2 vehicles were issued with PG9s with immediate effect (although they were allowed to take the vehicles home???) subsequently I have been told that they were both being used over the weekend before the PG9s were lifted on Monday.

Prohibition notices.

If they continue to use them the Police can stop them by seizing the car.

The PG9s were lifted on Monday After the cars had been MOT'd. But from what I am told the mileage that was on the PG9 and the mileage on the MOT and PG10 are significantly different. In one case it is a few hundred miles.

I had one of these once, it gave me 14 days to fix the vehicle (it was for a rubber bush on the suspension) i was allowed to carry on using the car and had to fix it within 14 days and take it to an mot station to be checked and stamped and then post it off to vosa. Even though it was issued at an la random inspection they never followed it up i called them to send them a copy and they told me it was nothing to do with them send it to vosa.

These particular PG9s were for immediate off road until fixed.

After a conversation with our enforcement officer today it would appear that the answer to the first question is neither VOSA or the LO will be doing anything about the drivers that used their vehicles whilst subject to the PG9.
This now begs the question, Why bother spending all the money if nothing is going to be done?

I suppose the problems got fixed, and if a pattern of non compliance can be shown to a court the driver will lose his license.

Also if a problem is found and the driver fixes it within hours, what offence could the driver be charged with if he goes back to work? :?

I would imagine the concern would be if he went back to work if the fault wasn't sorted.

If the vehicle is used before the PG9 is lifted then an offense has been committed. In the case of one of these vehicles the original fault had been rectified but the driver did not get the vehicle re MOT'd. He was told by the garage that it must be MOT'd and that it would fail an MOT because the brakes were metal on metal but he still went out and used the car over the weekend illegally and dangerously.

I am saying that VOSA are not backing up their own rules and because of this the LO also won't do anything.

I would send a formal complaint to VOSA, or join a union/association and get them to do it.

I am told that VOSA will not persue the matter because they are concerned about a possible legal challenge to the paperwork.
My guess would be that it would be claimed that the driver thought he was able to continue driving the vehicle because VOSA allowed him to drive it home and the council did not remove the plates.
