IMO this man went about it the wrong way, as soon as they said were going to suspend you he should have said, "I'm appealing against your decision". The Council then would have given him his badge back until an appeal at the local Magistrates Court was heard. In many cases the driver wins.
That is no longer the case. The council have the power to suspend immediatly if they considder the driver to be too great a risk. The driver can still apeal but he will not have his badge until he wins the appeal.
Er mm I think you need to look at some cases Granddad, no Council in this land can take your living away from you? All you've got to say is, "I'm appealing", 10 minutes later your back out on the road. The Magistrates love these Council cases.
I went in with a guy who'd accrued 15 points in
one day and won, the magistrates said to the driver, we are allowing your appeal on the basis that you will not accrue anymore points within 4 years we urge you to drive with caution. In 4 years he didn't get any points and now has a clean licence, he's one of the best drivers in our town he was just unlucky one Sunday that's all.
