whilst your reply is appreciated, it lacks the information required which is do we have to register with Data Protection and pay £38 per annum to be completly legal in having CCTV working in our taxis and if we do who becomes the Data Controller when the fee is paid, the person or the council who want control of the CCTV ie: they in effect become the Data Controller at the taxi owners expense, surly the taxi owner should be the Data Controller that is what they pay for, and the council have no contol over the CCTV with Conditions that they make to be the controller, surly they cannot override the Conditions made by the Data Protection Act.

In our view, small users of CCTV are now caught by the requirements of the Data Protection Act. This position is reflected in the revised CCTV Code of Practice which is available on our website http://www.ico.gov.uk/tools_and_resources/document_library/data_protection.aspx which you may find helpful when providing information to your association members.

If the taxi driver is self-employed and is legally responsible for the personal information being processed on the CCTV system in their cab, they would be considered as the data controller and would have to notify under the Data Protection Act 1998.
