Last Friday night we ran a promotion outside our local nightclub we were handing out leaflets offering 25% discount should the punter choose to get in one of our cars. Of course some of the other drivers took a severe dislike to this and since then we have been reported to our LA for touting. It is our argument that we were not touting we were just promoting our services. Would it be any different if it was a bar handing out 1/2 price drinks tokens?

Your opinions and veiws would be very welcome.

Touting(1)Any person who—
(a)in a public place—
(i)touts for the purpose of selling or advertising anything or otherwise obtaining custom so as to give any other person reasonable cause for annoyance; or
(ii)importunes any other person for that purpose so as to give that, or any other, person reasonable cause for annoyance; and
(b)fails to desist when required to do so by a constable in uniform,
shall be guilty of an offence and liable, on summary conviction, to a fine not exceeding [F1level 2 on the standard scale].


As you were annoying the drivers ,i would say you were, but then again i do not like touts :)

My view, for what it is worth, is that handing out flyers is advertising. Standing next to your taxi asking people who are passing by if they are looking for a taxi is touting.

Handing out flyers and saying to people something along the lines of "if you want a cheap taxi now, there is one over there" is touting.

If the vehicles were in view of customers when your colleagues were giving out the flyers, then I think a case for touting could be made.

If the flyer giverouters (my word of the day) said if you go to that one over there, then again a case for touting could be made.

However if the vehicles were not in view, and those giverouters said simply ring that number on the flyer, then you should be ok.

Did it again this Friday night, only with a big poster attaced to a truck advertseing the offer. I don't think were very popular amongst the Newark taxi community but we don't give a stuff they're all a bunch of idiots anyway. Waiting now to be interviewed under caution by the almighty LA- can't wait.

I'm all for free enterprise, but, name calling is a tad childish. Having said that I don't think I'd expect anything else from one side of the trade about the other. No wonder it's split the way it is :roll:

Just imagine if this kind of name calling came from the likes of Asda, Tesco and Sainsburys, how interesting would the advert break be then :D

It would probably make the adverts a lot more entertaining than the cr*p that the adverts come between. :lol:

Imagine it....

"Not just (food)....that's M & S (food)....but then again....if you're the kind of tight fisted, lacking in taste and nutrients, rickets stricken saddo, that goes rooting in the metaphorical sh*tbins that are Asda, Sainsbury's etc....just to save a few pence....then please do continue to let your family suffer. And as for Tesco...'every little helps'...'very little help' more like....particularly when you're in hospital with e-coli food poisoning from eating their 'value' range."


(Actuall, I may possibly have gone a little too far here and maybe a career in marketing is not for me. :lol: )

Anyway, I'm off to do my shopping.... in Lidl.

If I couldnt name call I wouldnt have an article!

You seem to wonder why the HC trade is resentful of PH......then you see posts such as this.

Although I dont actually think its touting......just a company actually getting off its ar*e and looking to build business.

Presumably when giving out flyers the people say can I give you this.....as opposed to can i get you a cab?

The touting law covers both PH and HC.

There is a school of thought that says it's easier to get a touting conviction against a hackney firm due to them not sitting/waiting on a rank. :shock:
