The Equalities Act 2010 will stop all restricting councils from refusing to license a new taxi WAV application, if they have a lower ratio/percentage of taxi WAVs to taxi saloons than a percentage to be set by the Secretary of State towards the end of the year.

With that in mind TDO has sent out FoI requests to all 86 councils that currently restrict. TDO wishes to thank all 86 of those councils that have responded.

TDO has coloured coded those that have replied. Those councils in the green have more than 70% of their taxi fleets as WAVs, most of those are 100% WAV, and will not be effected by the new powers in the Act. Councils with a taxi fleet of between 40% and 70% WAVs have been coloured orange. Until we receive the actual percentage by the Secretary of State we will not know what effect it will have on these councils, but it's fair to say it will more than likely effect those nearer the 40% mark than those nearer the 70% mark.

Those councils coloured red are the ones at most risk of losing their restricting status, two LOs from large councils have told TDO that they see de-limitation as their only via option. Even if de-limitation isn't the option taken up, it's clear to see that in some areas many hundreds of new taxi WAV plates will have to be issued.

Details of those 86 councils WAV to saloon taxi ratios are below:

Green 70% to 100% WAVs = 30 council (35%)

Orange 40% to 70% WAVs = 9 councils (10%)

Red 0% to 40% WAVs = 47 councils (55%)


The 86 Councils who have made a decision to retain quantity control.

7. Blackburn Darwen. 68 WAVs out of 68. 100%.

8. Blackpool. 180 WAVs out of 256 (motorised taxis). 70.31%.

9. Bolton. 110 WAVs out of 110. 100%.

10. Bournemouth. 45 WAVs out of 249. 18.07%

11. Bradford. 74 WAVs out of 225. 32.88%

12. Braintree. 18 WAVs out of 84. 21.42%.

13. Brighton and Hove. 126 WAVs out of 530. 23.77%.

14. Calderdale. Eight zones only Halifax zone restricted. 37 WAVs out of 37. 100%.

15. Cardiff. 493 WAVs out of 893. 55.2%.

16. Carrick. 13 WAVs out of 82. 15.85%.

17. Chesterfield. 140 WAVs out of 176. 79.55 %.

18. Chorley. 7 WAVs out of 36. 19.44%.

19. Colchester. 32 WAVs out of 130. 24.61%.

20. Congleton. 13 WAVs out of 42 (currently only 38 licensed). 30.95% (34.21%).

You didn't mention Winchester so I'll save you the trouble as they probably won't reply....... 49 saloons 127 Wavs..... :-| :roll: They have no plans to reregulate.... Open door policy on wavs with strict quality control :-|

So let's play devil's advocate and say the DfT will say 50% WAVs 50% saloons. Personally I believe it will be a higher rate for WAVs, but 50% is a good place to start.

Just on the red zone councils.

In Barnsley it will mean an extra 30+ plates.

In Barrow it will mean an extra 100+ plates.

In Bournemouth it will mean an extra 150+ plates.

In Brighton and Hove it will mean an extra 200+ plates.

In Chorley it will mean an extra 20+ plates.

In Colchester it will mean an extra 50+ plates.

In Congleton it will mean an extra 20+ plates.

In Dover it will mean an extra 30+ plates.

In Harrogate it will mean an extra 70+ plates.

In Hastings it will mean an extra 30+ plates.

In Havant it will mean an extra 30+ plates.

In High Peak it will mean an extra 100+ plates.

In Hyndburn it will mean an extra 30+ plates.

In Kirklees it will mean an extra 120+ plates.

The specific section of the Equalities Act only applies to councils that restrict. If your council doesn't restrict it doesn't matter.

But even if they did, with that number of WAVs I'm not sure it would have that much of an effect.

If it's less than 50% then that's not really going to fit in with the Equalities Act agenda.

If we go back to 1995 the gov envisaged 100%, so I will be shocked if it's less than 50%.

If I was a gambler I would say it will be 66%+. :shock:

Sussex.. You state is that if your council does not restrict then it does not matter..... I beg to differ..... when will you be putting up the figures for the council's that do not regulate numbers..... you need to see how good or bad they are before you can make a comparison.....

The bit I'm interested in, at the mo, are the councils that restrict.

Of course the SoS can also lay down rules in relation to councils that don't restrict, but if he was going to do that then one has to wonder why the gov didn't say the Lord's amendment was simply a waste of time.

Maybe, but I can tell you this for nothing, once the provisions in the Equalities Act come into being, restricting councils will have a lot more WAVs than they do at present.

In many cases 100s more.

I suspect there are many bad councils that don't restrict, but it's clear from the list above, there are plenty of bad councils that do.

Two wrongs don't make a right.

If folks can afford a plate, then they can afford a WAV.

Correct me if I am wrong but does or doesn't the provision in the Equality Act with regard to percentages/proportions of WAVs apply to restricting LAs only?

Isn't it just an amendment to Section 16 of the Transport Act 1985 & nothing else?

If that is the case & I believe it is, then unrestricted councils can carry on status quo, even if they have a poor or very poor WAV to saloon car ratio.

Unless that is I have missed something.

It applies to all councils..... the object of the exercise is to have more wheelchair accessible vehicles throughout the country...... and percentages will apply to everyone... so if your council is De-restricted and does not meet the percentages.... because of age of vehicle...... you might find them being told to scrap the age limit.... But what do I know or care.....

66. Sefton. 196 WAVs out of 271. 72.32%. and a hundred percent wheelchair accessible councils might well find themselves being challenged because they do not have any saloon vehicles.. it looks to me as the doors have been opened for more legal challenges :wink:
