As you rightly state, the 2002 survey is useless.

Object to what?
The fact that DCC have no up to date evidence with which to impose a limit? or that you want one and the council don't?
Any appeal to the courts would be a complete waste of money.

Object to all applications for Operator's Licences and Badge Licences by way of over provision !!

For a small sum from each member of the Trade, we can effectively halt any further newbie from contributing to DCC's coffers and overkill in the Trade ! Even if it is for the period of 6 months still, money well spent no ??

And who's to say, a Sherriff may concur.... [-o<

Anyone can object to any licence and for any reason. It only costs the price of a stamp.
Without evidence of over provision, the objections will most likely be dismissed.
At best, you would hold up the applicant until the following meeting.

I don't think you have the right to appeal, unless you are the refused applicant. I could be wrong there though.

If you have, your objections will be thrown out because there is no survey evidence to back them up.
Even if there was, the council are not obliged to limit.
They are obliged to issue or refuse a licence within 6 months of an application.
Unless there is evidence of no SUD or the applicant isn't fit to hold the licence, they must issue it or it is deemed issued by law automatically.
You really have no case.
You will have your own costs, the court costs and the council's costs to pay.
Also a possible case against you for lost earnings etc from the applicants.

And you are still left with a council which doesn't want to limit licences and doesn't have to.
Basically your screwed. :shock:

No, they already got a licence. Only applies to those awaiting the same fate.
