I think they asked the DfT too

In the ideal world no Taxi (or PH) driver would ever do wrong. If the problem is with section 52 mis-application, perhaps what is needed is for a different approach.

Would it be better to repeal section 52 as it is obvious that one (and now possibly two) Local Authorities can't be trusted with it.

Make it compulsory that all attempts at immediate suspension are dealt with by a bench of Magistrates within 24 hours. The Licensing Officer would have to have enough of a case to involve the Police (first barrier), the custody Sergeant (second barrier) the Bench (third barrier). The bench would have to find a case to be answered and could then set as bail conditions "Thou shalt not drive a licensed vehicle". Of course if it really was "putting at risk" the public, remand in custody is a really good way of achieving an instant suspension.

Why not just insist that councillors conduct themselves with a modicum of decency?

Wait a minute you would need guys to put their heads above the parapet for this.

Wanna bet the reason there is no action in Ashfield is that the cabbies are scared. How many are tax dodgers, don't weigh their wives in properly, signing on while working .... What other reason for them doing nothing?

If it were me I certainly wouldn't be doing nothing.

The council abuses anti-terrorist legislation - put in place by a fascist Labour government - temporarily suspends without authority to do so - how can anyone be unfit this month yet fit and proper one month from now - and betrays a complete lack of moral decency.

I would be looking at legal suit to get back the 2 grand lost in wages, the 1200 bucks in rental fees, the myriad extra charges by banks etc for missed payments on loans, mortgages etc.

21 guys, the council in Ashfield, with legal costs included, should be looking at a bill of up to 300 grand for its little spat.

And because Human Rights have certain;y been breached, there should be no difficulty attracting civil legal aid to do so.

Now why can't you ever find an NTA when you need one

Does anybody know how many of the 21 are members of any association or union?
