Hi

is there such a thing as forming an illegal rank for Hackneys, ie

if 4 Hackneys, park up with out for hire lights on is that forming an illegal rank, is there such a thing.

I can't see the problem if they are legally parked up and not working. However if the intention is to park illegally then it doesn't matter how many there are and also if their lights aren't on for work and they intend to ply for hire whilst parked up then I'd think that was illegal, but, I could be wrong

Look at this from a different angle. An official rank is for the use of taxis only, in order to prevent any other road users from parking on it. It is not illegal to park up where there are no parking restrictions on any road or street within your district - obviously you shouldnt tout your services, but if your for 'hire light' is on - then you are free to accept a fare if approached.

Only if waiting on an official rank.

My take on the regulations (could be wrong) is that hackney carriages can only accept fares if sat on a rank or 'flagged down' whilst driving. They cannot sit and wait for fares anywhere other than a rank.

My LA's byelaws (never enforced) state that drivers should wait on a rank and if there are no spaces available proceed to the next one, or keep driving around. But not park up and 'ply for hire' where there is no rank.

Doesn't stop them from parking outside every pub/club/bingo hall where there is no rank though, like I said never enforced.

all ranks are full, if 5 of the hackney park up in a side road waiting for room with out there for hire sogne on, the council say that is forming an illegal rank.

it is the word forming an illegal rank, i think there is no such regualion yes you may be in brich of parking regualtions.

Surely your bylaws are the same as most others in so far as if the rank is full you are expected to move to the next rank and so on and so forth

I remember a few years ago being given the same 'advice' from a local solicitor. This was given whilst I was parked up reading a paper and having a coffee break. He wanted to get home, and the walk to the rank was, shall we say, difficult for him that night. :wink:

I agree the point is this if cabs want to park up not for hire, is that forming an illegal rank, that the council can come along and do them for failing to move to the next rank, the point is they say they or not working at that point in time.

I think if ONE cab parks up without its light on it's not a rank, if more than one parks up a rank is formed, regardless of whether the light is on or not - technically you're still working (even though your lights off) therefore forming a rank.

If all the drivers left the vehicles, with the hire lights off they're not forming a rank, just parked.

Like has been said, if space is not available on a rank you are expected to move to the next one, or keep driving around !
