You are not required to wear a seat belt while fared up, plying for hire or proceeding to a pre-booked job.

Following the logic through, you are required tpo wear a seat belt outside of your licensed area once you have cleared a job and are returning to your home patch.

I am sure if you check when a HC is disengaged outside of his licenced area he must wear his seatbelt!!.I may be wrong but I think not.

I would think that he may be basing it on a hackney out of area may be refered to as a private hire car and as such the driver should be wearing a seat belt if he has no passenger on board.

Possibly, but a hackney is always a hackney and never a PH.
