So tell me, how does non attendance at court or a council hearing establish the guilt of the accused ? And how does your non attendance, shift the burden of proof, to upon you to prove your innocence? Why is there no option left but for you to be found guilty?

Remember, there is no evidence only one mans allegation, and in that respect at least, nothing has changed.

You're in the frame Mr. T an innocent man accused of a heinous crime against society.

The same thing could happen to any one of us. :shock:

Did you loose your brief for the incident

or

for non compliance with the gestapos procedures

Is int funny that drivers are held to the word of cgsa but the council can suit its self

Im guessing you lost for non compliance with procedure When infact the gestapo rc or council never followed thier own procedure

Did you get any written correspondence giving you the chance to reply before going being summoned to the gestapo meeting

Gotta laugh reli

I have to say that you and jasbar are the most persistent people I've ever come across :lol: It's a damn shame you're nuts or you could have well been useful in tackling the problems of the taxi trade :lol:

In your attempt to justify to yourself/us for not attending a council meeting you stooped to the lowest of the low and suggested that we think we have been accused of reading kiddie porn. You then suggest that we're the baddies because we would attempt to defend ourselves, whereas you think it's ok so long as you don't try to defend yourself and not attend any meetings etc to obtain the truth as you see it. What if the allegation was made by a punter that a driver touched them inappropriately. There would only be the drivers word and the passengers word for that. The council will make a decision based on the probability of that happening. Chances are the driver would be cleared until such time as there was a second allegation.

You clearly do not like those in authority within Edinburgh because they won't let you have what you want and probably because of some underlying event that none of us are aware of, and I for one don't care to know what it is. Your arguments are biased and so are your opinions tainted by your bitter experiences that you appear to have no control over. Keep up the decorating it's therapeutic :-|

You appear to be suggesting that if a driver touched someone inappropriately then the council would just record it and let the driver keep driving while this council has taken away a man's livelihood based on an incident that there is no proof ever happened. dearie me.,

Toots, Skulls licence was taken away because he is the Skull. because he had the temerity to oppose th e council and because he asserted his fundamental Human Rights.

The council set out to take away his licence, ignoring its own procedures in doing so, indeed in order to do so.

And you think this is acceptable.

I reckon you would have accepted Hitler's Gestapo because the nazis were originally elected to power.

And that's what worries me about you and he rest of the bewildered herd.

I said right at the start and on more than one occasion that this thread was not about me. I created a scenario that might put any one of you in the frame regarding a false allegation. Mr. T made an complete tit of himself, trade guru indeed, and the rest of you were just as bad.

You don't have to be a rocket scientist to know that a persons non attendance can't be used to establish guilt but only the facts can. Innocent until proven guilty is a fundamental right. If your guilt is not proven to some degree then you are innocent or, at least, the case is not proven. Even on the balance of probabilities you need credible evidence to make a judgement. A simple allegation doesn't come close to establishing guilt.

You lot are a disgrace. Not only do you try and defend the indefensible you would sell out anyone to protect the system that enslaves you. The trade Uncle Tom's like Trevor and Wayne are simply a reflection of the scum that drives taxis and the council are no better.

Non attendance at court will, providing the other side attend, guarantee a defeat, and a very large cost and fine bill.

A will give a common example.

Speeding fine. Doing 42 in a 30 zone.

Firstly the defendant should take the fixed penalty if he is offered one.

If not, and if the defendant doesn't attend court, the fine will be £350, the costs will be about £45, and a victim surcharge of £15 will apply. Even though there is no victim. :?

Leaving a bill of £410.

And this is the only bill, other than poll tax, that will lead to imprisonment if you don't pay.
