In a word, Control, the council thinks it controls the trade and for the most part, probably does. The trade “representatives” think they control the trade on behalf of the council and don't even come close. However, they do serve their own interests. They only control the idiots in the trade that believe they represent them. The problem lies somewhere between the two. They think they can control everybody and that couldn't be further from the truth. This is where we come in. We don't like being controlled by a bunch of numpties on the council or idiots running the trade. So far, so good, do you see where I'm going with this? Now more and more people want to challenge the council because they want to fill their pockets, or they believe a licence is there's by right. No matter how you want to look at it. The council is no longer as powerful as they once thought and are open to challenge through the internet and the courts.

Whatever the motivation self interest makes strange bedfellows, with enough will, to win at least a battle, if not a War. It just depends on how you look at it. :-|

Kind of thought it was something to do with that :D

So might this mean effective derestriction?

Could it have implications for the rest of Scotland, or even England

Was the case about the IP list - or whatever it was called - and thus really only relevant to Edinburgh?

But congratulations to those involved =D> \:D/ :D

I think we'd better wait for the Sheriff's decision before we answer that one. :-|

More than one thing happened yesterday relating to taxi plates.
And no plates have been issued in relation to the "carpetbaggers" case.

There are plans afoot, informally at the moment, by the council of major changes to taxi licencing in Edinburgh, and removal of the cap is not part of it.

maybe the terrible two could ask their councillor for more information, but maybe the councillor might not want to talk to them!

Just a case of premature ejaculation by jimmy boy and gary

I have been surviving on my own and will continue to do so for a very long time

So i'm a spineless sh-tehouse for standing up for an inherited plate value that the mass majority of Edinburgh plate owners bought in to, i'm a spineless sh-tehouse for wanting to save honest hardworking guy's from going under, i'm a spineless sh-tehouse for wanting a review/reform for a system or act that has been getting abused for years, i'm a spineless sh-tehouse for standing up against infiltrators of organised crime gaining access to our trade and finally i'm a spineless sh-tehouse for supporting regulation and restriction

I think you should take a good look at yourself, going by your photograph i take it you are a socialist potsmoking brain dead anarchist, alledgedly, coming from Dundee that is no surprise, Get this tx_op your not in the game, you have never added anything constructive in your life

Now the definition of Spineless in your terms means to me, someone out to destroy without regard for consequence

I rest my case

I know for a fact the council is appealing against nothing Frank. The licenses are granted and to unsist the remaining applications are merely a formality but consider their situation.

The council has granted to those on the IPL, and they didn't have a legal right to a plate. So what we have is, approximately 60 licenses granted either by the council or through the courts with 60 remaining on the IPL. And 60 bona fide applicants who were “persuaded” to take their money back? Told by the council they had no prospect of being granted a plate which, puts them in the frame too. However, are we not forgetting something like all of those who were never given the opportunity to apply in the first place, that have as much right as those who have already been granted a plate.

If you are thinking about applying do it now. The council will buckle under the pressure.

So after reading through the various pages of 'we've won' 'no, the council are still winning' . . . Can anyone confirm if any new taxi licenses have been physicaly granted over the number currently issued?

You could NEVE survive without the council propping you up. In an open market you'd go down.

You are where you are beccause you are gutless and bow before the council that protects you. And it's the removal of this parental support that frightends you.

Here's what MacAskill said.

"Since I've been elected I have always tried to be available for constituents and to represent their needs and wants ..."

MacAskill is a liar. I am a constituent. He failed to represent me over taxi licensing AND human rights. In fact he deliberately went out of his way NOT to represent me.

Here's what Alex Salmond said.

We all know Scotland has so much potential. We have the talent, resources and ambition to truly flourish. Working together, there is so much more we can achieve. With your support we can build on the work of the past foure years. Progress has been made and there is so much more to do.

Together we can make Scpotland better"

Salmond is either a buffoon, a liar or both.

Talent? Restriction of anything suppresses talent. Licence restriction suppresses talent and enterprise.

Ambition? Just as long as its not our ambition, eh?

Working together? Nope. Everything is on his terms. And a free market is not on his radar.

Together we can make Scotland better? Together? Just words. he's not really interested in together. It's his way or no way. he's dictating here, not working together.

Colin Keir's SNP administration of the licensing committee was a disgrace. An abrogation of every tenet of Salmond's claims.

Keir knew what the committee was doing was illegal. So it has been proved. They did what they did despite us warning them what they were doing was illegal. Donald MacLeod knew this, yet still the dirty deed was done.

So, Dougie, without a council propping you up with illegal practices you won't survive.

Because you are a fool. A commercial imbecile.

At least captain bob knew we were right. saw the writing on the wall, and bailed out. We did him a favour.

Our erstwhile trade Guru's (Uncle Tom's) or vested interests would have you believe they made an investment into the trade. They did not. Their only investment was to deny you your dignity by reducing qualified drivers to nothing more than that of casual labour. A taxi licence is yours by right. Don't let any council or taxi “owner” tell you different. You were not put on this planet to prop up their illusions of grandeur at your expense. The minute you put your ar*e in the saddle you are making an investment in your trade. You don't need to ask anyone's permission and don't let them make you believe otherwise.

Make your applications now and fight for your survival without carrying a monkey on your back. The trade is yours, so make of it what you will, it's simply a question of permission, yours or theirs.

skull,

at the risk of sounding a bit naive here, why is it that we should put our applications in now like you suggest? if the council are going to capitulate and open up then why don't we just wait for that to happen? is there any reason why i should be doing it now rather than waiting for some official announcement?(other than the fact i'd get the licence quicker by doing it now).

But hey!!!!

Thanks for strengthening my argument for a review/reform of the act that doesn't stand up in court

And whilst that Review/Reform goes ahead we may as well ask for a suspension of the multi abused allocation system

We have the evidence the CGSA section 12 doesn't work eh ALIT

I'm sure with an overall majority and the fact the SNP know the CGSA section 12 doesn't stand up in court the SNP surely wouldn't want to be seen in a bad light will grant all 3 :?:

REVIEW OF THE CGSA section 12

SUSPENSION OF THE WELL DOCUMENTED ALLOCATION SYSTEM

REFORM OF THE CIVIC GOVERNMENT ACT section 12

what are you talking about this time ????

In direct answer to your initial question “assumption is the mother of all [edited by admin] ups”.

Look at it from a strategic point of view without being emotional. The council has been locked in battle for years and have lost repeatedly. At the present moment, they have suffered their biggest defeat so far. They are down but not out of the game, still dangerous but financially on their knees.
It costs money to fight Wars and this has cost them big time. They lack the will, and the stomach for another confrontation.

This presents you with two choices, seize the initiative and finish the [edited by admin] off by going on the offensive, or lose the initiative by allowing them to recover, rearm and defend their current position.

What you have is a window of opportunity. Do nothing, “by waiting for it to happen” and control goes back to the council? However, if you apply now, you are forcing the council to capitulate on your terms. Once you have made your application you are in the process, the clock is ticking, and they are forced to show their hand.

If the council doesn't intend to de-restrict. They will simply pull the plug for a short period of time and put the cap back on after allowing the situation to redress itself, and you get your plate. And if they change the system somehow in the meantime you will still get your plate.

To be honest, if a full blown de-restriction of the market was on their political agenda, we wouldn't be having this debate.

The question you need to ask yourself is, do you really want a plate and are you prepared to take the fight to them?

Everyone who's won a plate so far has paid considerably less going through the courts. It may have taken a while but so does paying off between 50K – 70K's worth of debt not knowing if the council will pull the plug. :-|
