Lad which used to be on the same circuit as me, but went and worked in a different licensing district, killed himself yesterday.

I'm led to believe it was down to financial problems, which I'm very reliably informed could have been sorted by a couple of folks who would have bailed him out.

So the point of this thread is to say to anyone, who's in the s*** financially, that it's not the end of the world and their are good people out there who will help. Just have the confidence to ask for it.

Condolences to his family, and without wishing to turn it into an arguement, this is what happens when money runs short, and it normally runs short because of too many at the same game.

Anyway, as you said Sussex, don't do it, file for a CCJ and bankrupt yourself, it only lasts 5 years and it's not only a better solution to killing yourself, you should never quit, if you quit they beat you and that is what they want, so become a rash and itch em back.

A couple of points here. Bankruptcy will only work if you owe money to legitimate sources. You also need around £500 to apply to the courts to be made the subject of a bankruptcy order. A bancruptcy order will show on your credit file for 6 years. A bankruptcy order does not last for 5 years. It used to last for 2 years for debts up to £20,000 and 3 years for debts over £20,000 but these days provided that the person being declared bankrupt complies with the official receiver, the bankruptcy order is usually lifted after a few months.
Of course anyone who is thinking of declaring themselves bankrupt should seek proffesional advice as early as possible and remember it doesn't matter how much you owe, they can't send you to jail.

Not sure if it changed but bankruptcy had an automatic discharge after 12 months and the option (in simple cases/no assets) of early discharge after just 6 months

if he had needed to (and could) he could have taken a bank loan to pay cash loans off and then go BR


going bankrupt neednt lose anyone their homes (if mortgaged)

its far simpler and easier and doesnt even have a notice published in the local papers like it used to

It does not matter who you owe money to or how much you owe, they can't send you to jail. It is a civil matter. You can owe the tax man, the VAT man, the banks, it does not matter. Provided that you have not tried to commit a fraud by false accounting it is not a criminal matter. They can't always take your house, they can't take your car, They can't take your TV, in fact there are not many possesions that they can take. If you have an expensive car, they may be able to force you to get a cheaper one but they can't leave you without transport if you need it either for work or to get to work.

All I can say is I'm glad you drive a taxi and do not represent anybody with debts. It does depend on whom you owe the money, not all debt is a civil matter and you can be jailed for at least the following:-

fines from the magistrates' court
your Council Tax or business rates
maintenance for your husband, wife or children

This of course usually happens only if you refuse to pay rather than you can't pay

That is not the same thing is it. When someone files for bankruptcy it is because they can't afford to pay their debts, not because they refuse to pay. Council tax and business rates would be included in any bankruptcy arrangements.
Fines and maintenance are not covered by bankrupty but assuming that someone is being declared bankrupt because they can no longer afford to meet their debts then payments of fines are usually reduced to a sum that is affordable per week bearing in mind the persons new financial position, ie longer to pay. Maintenance paid through the CSA is also reassesed.

When your at a low ebb in your life your stuck in a lonely place indeed. Having been there and nearly getting the T shirt I feel for anyone who is suffering alone.

Some people on here know what happend to me some years ago, I was suffering but didn't know it then all of a sudden I had this feeling I was alone, basically I was a idiot but didn't like to admit it.

When someone says they are going to end it all don't tell them to shake themselves, it's a cry for help and don't need patronising.

Many people out there are suffering with depression but don't like to admit it, I was one of them. Being told by a shrink that you have a mental dissorder is nothing to be ashamed of, at first I was like "sh!t" I'm a nut job, it doesn't have to be like that. There's medication to help people along, there are support groups based all over the UK plus there's the sun that shines in the sky, there's nothing better than a bit of the old current bun.

I feel for the guys family, they must be going through hell asking the question why? The guy must have been going through hell to thinking about the shame he was going to put his family through if they found out.

No matter how serious the problem there's nothing better than a good old talk.

there are a lot of myths and fears over going bankrupt, did you know the courts will accept payment of the fees (approx £500) from a credit card INCLUDED in the bankruptcy?

all debts, declared and undeclared are included except student fees and current year council tax debts

Barclays and the Coop will give you a bank account even if you are bankrupt

private debts (family, etc) are not covered

payments to creditors whilst bankrupt are implemented for 3 years from any amount of available income over an agreed amount required to live on

you can keep a car if required for work (or is a tool of the trade)

whilst bankruptcy may only last a year, inclusion in the London Gazette is for ever

if your self-employed you can go bankrupt and carry on trading
