Your other problem is the court system and finding yourself in front of a strong Sheriff, and not just an establishment lackey. :-|

I think you will win but there are other factors to consider. :-|

That’s what I’ve alluded to in my posts Skull. Maybe on this occassion, unlike cases in the past, the Council’s legal team are certain that they can deny the application.

its not just about not hearing me when they could have its more about the fact that by their own admission there data is flawed.
they must keep themselves informed as to demand with up to date current accurate demand information.
theirs is 12 to 18 months old biased and flawed and contains errors.and yet they denied presumably under sec 10.3.
thats a fettering of their discretion.
comet commercial was brought into the conversation on more than one occasion.
one councilor asked where my wife was,i replied she was at work,"we like to see our applicants",i replied "or there representatives as allowed under the terms of the act",she then asked if she intended to drive the vehicle.
at which point macleod interrupted and set her straight on the law.
these councilors are buffoons,i have to wonder if this is the sort of uninformed nonsense that goes on when large decisions are being made on our behalf,trams etc
imo if you sit on one of these committee's then you should inform yourself of all the legislation

i can assure you they are not at all certain
a man does not fumble about trying to explain himself constantly flipping pieces of paper over unless he's been found out.
macleod relied on the stupidity of the councilors to deny.

Well, you've got to prove the council have acted in an unreasonable manner or contrary to natural justice. I think the facts of the case speak for themselves, and they've given you that much in writing. I'd like to see what a good lawyer makes of all this. And there in lies your problem, most of them are incompetent.

Remember Fiona Munday, that's a fu8king ar8e if ever there was one. It's a mystery to me how that dozy cow is allowed to represent anyone. :?

I didnae' realise you were not told why you had been denied. Do they now send a letter out with the reason for denial ?

nach your practically thrown out once they've made a decision.

they never tell you why because the councilors don't know why they made the decision not legally at least.
to them they think its up to them period.
ill get the letter and it will be sec 10.3 as it can be anything else

that prat of a cab inspector shouted at me that the next meeting mr mackie was to be held in private and i should go i ignored the prat and loudly said its not on the b agenda and sat back down

Btw, ( No’ that anyone is intersted ) the suite lasted 6 weeks before some big fat barsteward burst the springs ! Aye, 2008 that wis’ a good year. 55k to buy in, and a 2k suite that lasted 6 weeks. Lucky white heather...
