Birmingham cabbies fight bogus fines at Perry Barr’s One Stop Shopping Centre



BIRMINGHAM taxi drivers have launched a legal battle against ‘bogus’ fines of up to £140 following a parking blitz at a West Midland shopping centre.

At least eight TOA taxi drivers have been targeted with penalties of between £65 and £140 plus costs at the One Stop Shopping Centre in Perry Barr. One driver was collecting a wheelchair-bound customer.

Each driver received their fines through the post as security cameras were used to capture TOA taxi drivers picking up and dropping off on double yellow lines, and also driving through bus lanes.

But Hackney Carriage rules and the law states: “Hackney Carriage and private hire are allowed to pick up and drop off all customers for a reasonable amount of time in bus lanes, double yellow lines and yellow hatched areas.”

The company responsible for handing out the parking fines is Care Parking, a division of Anchor Security Services, based in Chester.

Since disputing the fines drivers say they have received letters from debt and bailiff recovery services threatening county court proceedings and vast increases to sums allegedly owed.

All the drivers have appealed against the parking fines, but so far to no avail.

The range of fines vary from £65, if settled within two weeks, to £90, within 28 days, or £140 plus administrative costs after 28 days.

Manawar Hussain, Chairman at TOA Taxis, said: “It’s shocking to think that companies can go around acting in this way.

“One of the jobs our drivers got a ticket for was a wheelchair access job, where the customer needed picking up from the front of the shopping centre and it’s the front where we’re being fined.

“If there are any other Hackney Carriage or private hire drivers out there that have been fined in the same way, do not pay, it’s a scam.”

A spokesman for Care Parking said parking regulations applied to the bus lane, which was private land. “These regulations have been legally introduced by the landowners and we enforce them on the landowner’s behalf. There is no question of unauthorised or bogus activity taking place.”

Why did they appal them,?they should have thrown them in the bin, the tickets are only a receipt

It's actually an invoice for trespass.

And as trespass is a tort in law, they can only take out an injunction against the perpetrator.

Skippy is half right, the drivers should just have ignored the 'invoices'.

On the peepipoo site they list every scam artist like this, and all the different letter you will get sent by them all. However they rarely end up in the County Court.

I had a curry with the TOA Company Secretary last Tuesday evening and told him about the Pepipoo site.

Having read through the threads on that site they called in the Birmingham Mail to give them the story.

No private enforcement company has been to court and won.

Has anyone tried to summons these companies to a small claims court for something like invoicing them for the cost of removing parking notices from car windows and associated stress etc?

yeah.....I wonder how they would like summoned to a county court somewhere?

Get a garage invoice for £50 for the removal of the sticker.

Get taxi receipts to and from work on that day.

Get taxi receipts for the visit to the doctors.

Bundle it all up send them a bill giving them 28 days to pay or face a summons.....then go to the county court and get the forms - pay the fee - fill the forms in and go for it.

Have you ever done that?

If you fancy having a go, the County Court with give you a set of 8 leaflets, each one covering just one stage of the process.

The first one or two cover the processes you must go through, by law, before issuing the summons and the last one tells you how to get the bailiff involved.
