I had an odd incident yesterday at Liverpool airport, which is outside my licensing authority. I had just dropped off a friend at the designated point and was just about to pull away when a man walked over, flashed some I.D. and spoke through my open driver's window. Conversation went somewhat like this.

"Hi. Enforcment officer. Let me see your badge. certificate etc. Turn your front wheels to the right. I'm going to inspect your vehicle!"

"Don't think so mate. I'm not licensed by your LA."

"If you are doing business in Liverpool you are under our juristriction."

"Err no I'm not. Now move out of my way please."

"I will report you for non compliance"

To who? What you going to do? revoke my badge? As you don't issue it, that's going to be difficult!!

Then I drove off. What was this numpty on about?

They are entitled to inspect any taxis or PH picking up or dropping off in their area I know last year our LO told me that two local vehicles were inspected and reported to him by enforcment officers at gatwick

Probably a bad move on your part as undoubtably you will have been reported to your council and may be penalised

They may be entitled but does a driver have to comply with any other LA. Rules may be different etc. I have had good read through my conditions of licence and other area officials are not mentioned. Of course if it was a Police officer I would have been legally required to comply.

They can inspect your vehicle as you are in their area, even thu they most likely cant do much they can still make your life hard.

I am thinking that, in order to prove that they have any Authority over you, they would have to be able to show that you were trading in their area.

I think that, if you were passing through, but had a fare Paying Customer, they would have some Authority over you, but I have no idea of the limitations of that Authority.

They can't touch the vehicle....what on earth do people think the carryings on about the berwick out of town plates was about?

Isn't there some sort of agreement in Merseyside such that LOs have powers over drivers and vehicles from other areas?

Of course, actually telling the drivers about such an agreement may be a different matter.

Mansfield Council have taken plates of other Taxis not licensed in their area who have failed the spot check.

The licensing legislation and things like police powers can be very different north and south of the border, thus it's always best to say where you're actually working. Indeed, that's why the forum has a Scottish section.

Not that this kind of thing is unusual on the forum. Not naming names like, just saying :D

Evidence submitted by Liverpool City Council to the Transport Committee's investigation last year said:

"Enforcement officers, via a Merseyside local authority agreement, also regulate the activity, when
appropriate; of private hire vehicles licensed by other district councils when parked in the City of Liverpool
awaiting pre-booked hiring’s from a licensed operator. This activity includes vehicle inspection and licence
checks to ensure that no licensing contraventions are being committed."


The minutes of the Law Commission's advisory group meeting from last year also refers to a "concordat between local authorities on Merseyside" in the section on enforcement and cross-border issues. (para 1.57)
