Its bloody awful mess to be left in...It's 3.15pm School pickup time, Your one and only plated car has just broken down, you cant employ another operator unless you stated so on your framework that you would be sub contracting work out. The parents of the stranded School Kids can't be contacted, your Local School transport people knock off at 2.30pm, Whats your options?

Wouldn't common sense allow you pick up the Kids in an emergency in your own private vehicle or hired vehicle If its Insured with passenger cover (as they are), your own Insurance would be OK if you waived the fare and took the Kids home on a Voluntary basis (not for Hire or reward), As long as you could prove you are who you say you are by your Taxi Badge or Drivers Licence or if the Kids Know you as they use you everyday.

What's your take on this one folks..?

That's why we have friends in the trade that can help us out from time to time.

The vehicle will not be insured, no matter why the hire company say.

But I understand the frustration this must cause.

In Lincolnshire you can use an unplated vehicle as long as it has appropriate insurance i.e. Hire and reward and 10 million PL so if this was arranged so that it was covered by his insurance it might be OK it's the insurance that matters to the contract awarders

What law applies in your manor then, cos it doesn't apply anywhere else?

Staffs CC have a big list of "authorised" contractors (all HC/PH or bus/minibus ops), If I cant pass my job to one (meaning i can agree the charges) then i can ask Staffs CC to find one, as it is i have good relationships with 3 or 4 other taxi/PH firms who know i can be trusted to pay, ive had £350 worth done and paid, this is the crux of the issue -- "will i get paid", I hope the guilty party knows the school has extensive CCTV on site, from the intercom/entry point, gates and car park......

the interesting bit is that the transport is run (in my case) by the COUNTY council, they have no concept or idea about legislative matters concerning my licensing (done by my DISTRICT council), for example they say i can pass a job to any operator, hack or PH,regardless of where they are based and licensed and when they said all cars would need to display owners name and contact detail signage i had to tell them my LA has to see and approve all signage......and that was that, no more heard.

as has been said, its POSSIBLE that by not charging the unplated car could be used, but that isnt the case as the operator has denied doing it

We have one particular contractor who used to run a taxi firm who holds numerous contracts carried out in private cars (mostly family members) some by licensed taxis and there used to be a chap in town held the contract to take his own special needs son to and from school. There is a 3rd type of insurance for vehicles that only do contract work which is accepted by Lincolnshire as long as there is also 10 million PL insurance as well
