We often read that so and so Federation/Association is negotiating on behalf of it's "Apparent" members!

Down here for example there are discussions on going, re age related vehicles (Taxis/P.H) with I believe two Fed/Ass claiming to represent hundreds of drivers, and then you have the P.H owner operators who no longer drive claiming that they represent their drivers.

So I am thinking.

To make this truly a consultation exercise, thus legal, don't the L.A have a legal duty to 1) Check the "Apparent" membership of these Fed/Ass to see as to who they actually do represent? - because they do not represent me (self employed) and no doubt many hundreds of other drivers! 2) To also look into "Companies/Owners" who claim to represent 100s of P.H drivers - because they clearly have a conflict of interest e.g They would obviously prefer brand new cars all of the time - it will cost them nothing - but it will cost the drivers thousands of pounds.

To me this is illegal from the L.A's because they do not clear the decks by auditing/checking that the representations i.e Fed/Ass actually do have the authority that they claim - Representation! I also believe that they should be inviting all those to the consultations with an "Independent" interest, (or most certainly an audited body representing "Independents").

It is to my mind an illegal consultation all round................Am I wrong? Put me right if I am.

If they say they represent all licensed drivers then clearly that's a lie, but if they say they represent their association then that's not.

Why not get together with some mates and start up your own? :?

It has been reported in the local rags and I believe "minutes" of meetings by both parties Fed/Ass, of the Hackney drivers membership numbers, from what I can see the L.A have taken it at face value. Take the situation re "Unite", whereby they had to come up with the actual percentages of members voting for a strike - it does clearly demonstrate for anything to be declared legal.............then it is open to verification!!

We are all treated individually as individuals (if that makes sense) when it comes to paying our license fees!! so the L.A's do not have problem in communicating on a one for one basis. My feeling is that all drivers affected from the word go, regardless as to whether one belongs to a (shall we say Union), should have an opportunity of input re apparent consultation exercises.

My view is that if any self employed trader (and that is what we basically are) regardless of the demographics/paper work etc then they should be involved. For any one to hide behind the excuse of ( we would not get them all in the same room, is mealy mouthed and leaves the process open to manipulation as there are many venues that can cope with anything from few dozen up to thousands).

What I feel people have to ask themselves is this.................... am I happy to let others decide my future who I do not recognise and falsely claim to legally represent me?

Are the L.A's complicit in allowing what is virtually false "Consultation"?

If.. your LA is actually trying to do something.. for the betterment of the trade.. then they can only work with what is give to them.... if you want to be part of the process... and you have similar like-minded colleagues... then ask the council what they require of you to be part of the procedure.... it's not their fault if people try to control and other people are happy for them to do so.... you only find out by asking...

As you say "If"!!!!!!!!!

The longer I live.............the more cynical I become. I look around and see council buses that are donkeys years old - school contract coaches that are nearly as old as me - mini buses that have long seen better days, and then there are Limo's riding around with a British prefix that some would find it difficult to work out what year it was - "Betterment", if only that were the true reason - it is only partial, and in many cases not justified.

Why are we as a trade allowing ourselves to be picked on? - it is not happening to others!!!!!!!!!!

I would disagree with you on that one as they are perfectly aware of what is required for it to be constitutional and legal! They are happy to go along with something that they can duck bob and weave with when the sticky stuff hits the fan, i.e a legal challenge.

The process that they are happy to preside over................makes it easier to get their own way, rather than to be dealing with each and every trader - and of course it is much nicer for company owners to pass the buck onto their "Owner Employees" :roll: - to make their fleets look more attractive.....................at no additional cost to themselves :roll: - so they are very happy to go along with it :evil:

Association normally well intended but the LOCAL advises of their limitations normally a Lawyers gravy train advice join a proper UNION! take the industrial route 10000 drunks smashing up the town on a Saturday night tends to get results =D> =D> =D>

Indeed they have but they could or should be able to assist in solving Cabby John's predicament which might be top of his agenda at the moment? and hopefully as a member he could then start addressing the events you rightfully pour scorn upon Dear Captain???????????????????????? :doubt: :doubt: :doubt:

Your right the Unions should not have allowed the illegal wars to have happened , obviously the entire country would have supported and participated in a GENERAL Strike? yeh right! 1 million people marched through London and attended rallies trying to prevent it but no-one listened did they?? The TUC and most Unions condemned the War, the mood now within Union's is never again all monies donated will be strictly targeted and of course the donations will be to the Labour Party
New Labour is DEAD.

I still think Cabby John's problems would be better dealt with by a Union the RMT, Unite and the GMB all have sections in that area and councillors on the local authority plus of course MP's Just like your local association hasn't :D it aint rocket science is it get the in with the Professionals! =D> =D> =D>
