Taxi drivers are mounting a High Court bid to stop a new 20mph speed limit for a city centre.

Brighton and Hove City Council is to introduce the limits on more than 500 streets from Monday and has said the restrictions will still go-ahead despite the legal challenge.

But, claiming they were not properly consulted, members of the city’s taxi trade have given the local authority until today to respond to a letter from their solicitors.

If they ignore it, then judicial review papers will be served to the High Court.


A judge would then decide whether to hold a full hearing into the matter, which would leave the council facing potential legal costs of tens of thousands of pounds.

However, council bosses have said they have sought legal advice and the order does not mean it will have to postpone the introduction of the restrictions.

Councillors gave the go-ahead on the first phase of the 20mph proposal in January.

The local authority claims the move will improve road safety and air quality.

However, unions representing cabbies claim the local authority failed to consult directly with either its members or the city’s taxi forum.

The Argus understands their complaint has been taken up by lawyers on a no-win-no-fee basis.

Ian Davey, the council’s transport committee chairman, said: “The city has been discussing 20mph speed limits for the past three years and the public consultation carried out last year had nearly 3,700 responses.

“There were also several meetings with representatives from the taxi trade as well as other stake holders.

“So the council has done everything properly in carrying out this consultation.

“It is regrettable that the taxi trade think otherwise and appear determined to stop the speed reductions going ahead.

“Given that the new speed limits are being introduced in response to requests from local residents and are intended to make our streets safer and more pleasant that is regrettable.”

The seven-kilometre area in the first phase stretches from Sackville Road, Hove in the west to Freshfield Road, Brighton, in the east.

The northern boundary will be Old Shoreham Road and New England Road.

Road crews have been installing signs and painting markings on affected roads for the past six weeks.

The council has further plans to widen out the scheme to suburban areas over the next three years at a total cost of £1.5million.

But what percentage of the population ACTUALLY vote in local elections and what support did the cabbies give to their Unions sponsored candidates who would of course stopped this 20mph crap, and of course a cabbie from the Union could have been on the council why didnt it happen ....oh i know apathy ....still they've a JP or 2 I am told FFS

Taxi drivers have dropped their threat of a judicial review of 20mph speed limits – after council leaders said it will review its effectiveness.

Brighton and Hove City Council introduced the restrictions on more than 500 residential and shopping streets in the city centre on Monday.

However, cabbies were unhappy claiming they had not been consulted properly when the issue was discussed last year.

Despite issuing a letter warning they would consider taking the issue to the High Court, lawyers acting on behalf of the trade have now withdrawn the threat claiming to have won a number of concessions.

Those representing the taxi forum said they were committed to making sure the council reviewed the scheme within three months.

But last night council bosses said this would be “ongoing” from now.

Richard Schaverien, of Brighton-based QualitySolicitors Howlett Clarke, said the taxi trade was not against the limits on residential roads and “high risk areas”, like schools.

He said: “The city’s main taxi operators will now be far more involved in the implementation and monitoring of this scheme, about which they continue to have serious concerns such as increased journey times, fares, fuel emissions and driver safety at night.

“We also note the council’s intention to consult further with taxi operators and to ensure their voice is heard when a planned period of monitoring and review into the effectiveness of 20mph limits is carried out.”

The first phase of the 20mph limits stretches from Sackville Road in Hove to Freshfield Road in Brighton.

As part of a £1.5 million scheme, the local authority hopes to roll out the project to the rest of the city over the coming years.

Last Monday, The Argus reported taxi drivers’ claims that the papers had been served to the council.

However, lawyers at the local authority said this has not been the case.

Ian Davey, chairman of the council’s transport committee, said: “I’m very pleased that the introduction of the 20 mph speed limit areas is progressing as planned and is making the city’s streets safer.

“I can confirm that proceedings with regard to a judicial review have not been issued and there have been no alterations to the initial roll out of the scheme.

“We carried out a robust consultation for this first phase and any future 20mph speed limit areas across the city will also involve a great deal of investigative work and consultation.”
