Today I had an incident which made me realise that the law is totally an utterly out of date. Picked up 5 passengers that had been partying hard all night as we got going I was suddenly aware that one of the passengers had pulled a large device out of his pocket which looked like a large metal block with a bottle attached and was exhaling large quantiities of white "smoke" into the vehicle he took several puffs on this BUT I have no idea if he was doing anything illegal other than this smoke smelled and was not pleasant. I opened windows but was still effectively having to "passively smoke". Afterwards I was caughing my lungs out for about an hour and a half

1) What is the legal position on this is the passenger doing anything illegal and have I as a driver the backing of the law if i ask them to stop

2) has any research been done on the medical effects of these contraptions and any assessment done of the effects of "passively smoking" this Vapor/smoke

3) Could I be held liable if a passenger suddenly starts using one of these devices and I am pulled by the police ?

You can ask anyone in your vehicle to refrain from doing anything you deem to be unpleasant.

None that I'm aware off, but then again I don't smoke.

I don't smoke either but whatever was in this thing seems to have caused me to have an allergic reaction (asthma attack)

I am now convinced that the legality of these things should be seriously reviewed along with potential health effects

Did you ask what it was or did you just assume?

It could have been a crack pipe for all you know. :wink:

You'd have to know what it was first, before making such a statement. #-o

Apart from which, you don't need the law to decide what can or can't be used in your vehicle. That's up to you.

There's no law against eating a kebab in a taxi. I still don't allow it in mine.

As an avid vaper ( that is what we call ourselves) my personal vaping device has helped me stop smoking after 15 years. I have now been of the death sticks for almost 5 months with no craving for another one!!!
I do however believe that a vaper should be conscious of the environment around him. i.e public places, taxi's, around children. etc and not vape without prior permission.

If it was an e cig all that come out of them is water vapour, last week the EU refused to put them under the same legislation as normal cigarettes as they don't emit smoke of any description, and the juice is plant extracts with food flavourings and less nicotine extracts than taking a sing draw of the real thing, but they advised that they should not be sold to under 18s without medical approval, I cannot find the report if I do I will post it.
All the vaping shops were pleased with the result as it would have meant they would have gone out of business
Just a footnote, 8 months now and on zero nicotine strawberry flavour :D
