seems very harsh im sure she can appeal right.

Yeah I've just told her to appeal. The LO slammed his hand on the desk and called her a liar.

Report him to the standers committee as not fit to hold office I would infact send me details and I will do it for you.

The case got adjourned until November. The Council offered her a 6 week suspension instead of the 8 week.

Is she still working ? And are the trade helping with the costs ? Why was it adjourned seems straight forward to me, and have the council sacked the licensing officer yet, he/she is very incompetent and seems full of there own importance. Hitler springs to mind.

Yeah she's still working and the costs are going to be met by the Council when she wins. It got adjourned because the bench didn't know what to do with it. They've adjourned it to Worksop Magistrates Court, why Worksop I'll never know??

Your right about the Licensing officer, he's a Hitler, ex coppers and Licensing officers don't make good people.

Just been told your hitler is fighting for his life? He crashed his car into a block of flats apparently.

Yes two weeks ago tomorrow. I was sat at the lights when it happened, it's a wonder he didn't kill anyone. He took a wall out, a lamppost and the main doors to the flats.

He can hardly walk plus he's of a rather large build, a few months ago he had to go home because he couldn't get out of his car in the Council offices.

Perhaps you can post the court case on here. Should be a good read.

Did they discuss proportionality?

Dunno I've not seen her yet, I couldn't get to the court case as my car was off the road.

Do you know what, I didn't consider that.

Not necessarily in relation to dual licenses, but if she had a PH license as well.

In short they couldn't ban her from driving PH if she was suspended from driving HC.

Well they could, but I bet they haven't. :-k

Ours is a Hire Vehicle Licence. I'll dig it out and post it on here.

Their website isn't coming up with any byelaws. I've typed in Hackney Carriage byelaws, Hire Vehicle Driver byelaws, Taxi byelaws.

As a hackney carriage driver she would be regulated by byelaws.

The chances are those byelaws will not contain anything regarding reporting offences - although the PH license probably does.

As Sussex caught on to what I am saying quite quickly, the essence is they can either suspend the PH part of her license but probably not the HC part.

James Button covered this subject when he gave his presentation to the National Taxi Association - he did go into dual licenses because a wise administration officer asked him to. The transcript hasn't arrived yet, but will be sent to members when available.
