On September the 22nd one of life's beauties (a hoody pedestrian) decided to ignore a traffic light/crossing instruction to STAY, and proceeded to cross the road not looking at traffic to the right or the left. The ped was in many words mesmerised by the contents of his takeaway (he was looking directly at the contents), the consequence being was that although I swerved to miss him, he continued as if I were not there, and walked into the side of the front wing of my cab.

He ended up on the road with his nose bloodied, and an ambulance was called. The ambulance took about 15/20 minutes to arrive. During the time it took to come, he was encouraged to stay down on the road by his mates i.e don't move stay there, however when it arrived the miracle happened - he got up and walked to the ambulance by himself :roll: At that time the police arrived, they managed to get statements to say that I was not speeding and the non existent damage on the vehicle clearly demonstrating that I had not hit him - "he had in effect, hit me". The police were satisfied that I was not at fault and put it down to intoxication of the ped not looking were he was going. At the end of my shift I called into the hospital to see as to how he was, only to find that he had been discharged ours ago :D :evil:


THE DOWNSIDE.

I reported the accident to my insurers as I did not want any comebacks and you have to do it anyway. Remember this is a no claim NON fault accident!

My insurance is due for renewal and they have been dragging their feet!! This morning the call for renewal comes and my insurer wants to drop my no claims down to 2 years only, thus increasing my premium to £800 more than last year :shock: :evil: :evil: :evil:

The brokers are going back to them to see as to what can/should be done. I have told them that there is not going to be a negotiation on it - reinstate or I am off :evil: :evil:


Has anyone else encountered similar?

They're in business to make money, you telling them is a licence for them to make money off you. If the Police blamed him then there was no need to tell your insurance.

same happened to me, a truck swiped my OS rear wing when he wandered across the lines, wouldnt admit blame, i paid my repairs the HE tried to claim off ME (Mondeo VS Volvo tipper) the accident was in October, renewal in January was up from £1200 to £2000 as my NCB was frozen, so i had to pay up and hope

by me then counterclaiming the truck firm (40 trucks) dropped their claim in May and my NCB was reinstated and I got a cheque for the £800 in September

its a good job the passenger in the truck didnt count as an independent witness or id have been stuffed

Nige, i think you will find you are obliged to report all incidents or risk not being covered should a claim be made later, and then it goes on the database, which the ambulance chasers have access too....you know the rest

You are right, the OP has up to three years to make a claim. By not telling them you would invalidate your insurance..........the OP could come after you for damages/injury claim.

Why if it was his fault? The Police cleared John of all blame plus, if he was p!ssed then there's nothing to report?
