In all fairness when you are being charged with a very serious offence as rape, you need to know the fulls in and outs of what's happening.

It's not the same as getting the correct street.

Cumbrian taxi driver accused of sex attack


A TAXI driver has gone on trial accused of carrying out a sex attack on a passenger.

Dariusz Kowalczyk, 48, is accused of “behaving in a sexually predatory way” and of launching a serious assault on the woman after parking in a secluded part of Carlisle.

Kowalczyk, of Esther Street on the city’s Currock estate, denies orally raping the woman after she hailed his cab when leaving a nightspot.

His trial got underway at Carlisle Crown Court yesterday, where barrister Timothy Brennand outlined the case against the cabbie.

Kowalczyk, a Polish national, sat alongside an interpreter in the dock as the court hearing began.

Mr Brennand said the woman at the centre of the case, who is in her early twenties, had been out in the city centre and had become separated from friends at the Outrageous nightspot in English Street.

“She decided, having lost contact with her friends, she was going to make her own way home,” Mr Brennand told a jury.

“She went to a taxi rank and got into a taxi being driven by the defendant.”

The woman asked to be taken to the north of the city but Mr Brennand said she was taken out of the city, near to the London Road junction of the M6.

In a taped interview played to the court on video, the woman told officers: “The man took me the wrong way. He didn’t take me home.”

Mr Brennand said the cabbie drove to a “dark and secluded area and parked up”.

The woman, he added, was ordered to get out of the back and into the front of the car.

“She was manipulated and, the prosecution say, coerced and threatened to behave in this particular way,” said the barrister.

The court was told she was ordered to perform a sexual act on the cabbie but she refused.

Mr Brennand said Kowalczyk then drove her to a “quiet spot” at Stainton, near Etterby, Carlisle.

There, he said, Kowalczyk is alleged to have carried out the attack. This lasted for a few seconds, the court heard, and the woman got out of the taxi.

“It’s not clear from the evidence whether she was bundled out or was able to escape,” said Mr Brennand.

She was found by a passing motorist in a distressed state, the jury was told.

“The prosecution contend she was in no fit state to give any consent to what this defendant had on his mind at all,” said the barrister.

Kowalczyk was arrested and told officers the woman had made an advance to him while in his cab.

Mr Brennand said: “He claimed everything from the beginning to the end was consensual.”

The attack is alleged to have happened on March 18 last year.

The trial continues.

Accused Carlisle taxi driver denies sex assault



A TAXI driver accused of carrying out a sex attack on a woman passenger told police she was a willing partner to what happened after he agreed to pay her £20.

Dariusz Kowalczyk, 48, has denied behaving in a “sexually predatory way” and launching a serious assault on the woman after parking up in a secluded part of Carlisle.

The defendant, of Esther Street on the city’s Currock estate, denies orally raping the woman after she hailed his cab outside a city nightspot in March last year. As the prosecution got underway at the city’s crown court yesterday, the jury heard a transcript of his interview with detectives.

“It wasn’t rape,” was one of his first comments.

He claimed that after the woman got into his taxi in the early hours she talked about sex, and kept touching him.

“She fancied me – something like that,” he said.

He claimed that she wanted sex, and asked him to go back with her to her home but he refused.

Questioned further by the officers, Kowalczyk said he had decided to park up on a secluded street in Carlisle but she then asked him for money.

“I said £10 and she said £20,” he told the officers, saying he eventually agreed to £20. He said: “I didn’t force her.”

Kowalczyk went on to tell the officers that he had met the woman on a previous occasion, when she offered him “services” for £10.

After the sexual encounter on the night of the alleged attack, he said, he dropped her off outside another pub and she fell over the kerb as she got out of the taxi.

Prosecutor Timothy Brennand said the woman, in her early twenties, had been out in the city centre and had become separated from friends so took the taxi, asking to be taken to the north of the city. She told police she was taken by Kowalczyk to a “dark and secluded area” where she was attacked.

The trial continues.

There's a brilliant new invention called CCTV, if the cab had that installed then we'd know exactly what was said and what happened.

I have no idea whether he's guilty or not. but 2 things concern me

1. CCTV would have assisted him were he not guilty.

2. There are very many fallacious allegations of Rape every year, which can destroy the accused life completely.

Lets hope justice is done for all concerned on this occasion.

Carlisle taxi man denies ‘rape lies’


Polish taxi man denies rape

A taxi driver accused of sexually attacking a passenger has denied inventing a string of lies to cover his alleged crime and continued to insist it was the woman who made an advance on him.

Dariusz Kowalczyk, 48, was giving evidence at Carlisle Crown Court where he denies orally raping the woman.

Speaking through an interpreter the Polish national said that he had driven the woman at the centre of the case to Scotby after picking her up outside a nightspot in the city centre on March 18 last year.

He said: “I’d been working for almost 12 hours I was exhausted.

“I was on my way back from Currock, I drove past the vicinity of my house, I said to myself ‘one more job and I will go home’.”

Kowalczyk said that when they arrived in Scotby the fare was around £8 or £9 but when he asked her for the money the woman changed her mind and said she wanted to go back to Carlisle.

Prosecuting barrister Timothy Brennand suggested that Kowalczyk had “wanted something different” rather than money.

The cabbie replied that they did not have sex in Scotby and during the journey back to Carlisle the woman had climbed into the front passenger seat and started touching him while he was driving.

Kowalczyk said that the woman had been talking in a sexualised manner throughout the journey and he thought she was a prostitute he had met in December 2012. He said: “When she changed seats I did recognise her – it was her [the prostitute].”

The prosecutor suggested that he had switched off both his radio and taxi meter was because he did not want the controller to know where he was.

Kowalczyk said: “I was tired and I wanted to go home. It’s a common way of doing it among taxi drivers – you just switch your meter off so there’s no conversation needed.”

Mr Brennand said that Kowalczyk’s evidence amounted to a “set of lies” but he said: “No it’s not, it’s true, all I’ve said is true.”

He added that he had felt ashamed over the whole episode, especially when his wife found out and he later lost his job.

The trial continues.
