The company's that you allude to have not done anything illegal. They are working within the law as it stands. The fact that they can do it is down to pi55 poor standards in certain areas and maybe trade associations should be putting pressure on these councils to improve their standards. You seem to think that law abiding people will break the law just because they can.

they are often advising drivers to license themselves in other areas when they cant pass the requirements locally - not illegal but IMO immoral - indeed, why don't the DfT use the deregulation bill to close the loophole?

On this I agree. Has anyone suggested this to the DfT?

No I am not saying a legitimate PH owner will suddenly change their modus operandi, but it has happened.

I'm sure those PH firms in Manchester and Trafford who now have Rossendale and Gedling HC's working on their radio circuits - simply because the drivers find it easier to get licenses in Rossendale and Gedling over Manchester and Trafford don't consider themselves to have changed their modus operandi either.

The problem is we're not going to get tougher or better standards there are too many greedy opportunists for that to happen. Thus my concern that they won't be the only ones to take advantage of the changes. BTW where did you buy your glasses?

The standards are set by the councils. Perhaps trade associations should be contacting organisations such as NALEO and trying to get them to put pressure on the councils who have low standards. I take it that you also think that law abiding operators will suddenly risk everything because an opportunity is put their way?

The one that I am often on about does not fall into the law abiding category.

It is my opinion that our council are to scared to take him to court on anything. I think he has something on someone and I also think he is a member of the dodgy handshake fraternity. I have shown that he overcharges customers on 3 separate occasions. He uses drivers who are not licensed to drive his vehicles. He refuses to accept that TUPE exists and insists that drivers and escorts must be self employed. I have it on tape explaining to a driver how to evade paying tax. The list goes on. I don't know how long he is allowed to operate the private hire side of his business in the name of a dead person but our council seem to be OK with it.

so basically these changes via the deregulation bill wont make one iota of difference to this chap who will continue to operate in his own way - personally I think the deregulation bill should have been used to stop people flouting the law - as opposed to legalising the flouting.

He definitely falls into the category of law breaker now, law breaker later. He thinks he is bullet proof and always has. The council simply won't take him on, but I got 7 days to fix a scratch. =D>

Trade associations are contacting councils and licensing bodies but they aren't listening or they don't care, you choose  I think law abiding operators are few and far between and yes I do believe that some will take risks if the chances of them getting caught are low. To be fair tho it's not the ones that are licensed that concern me it's the unlicensed drivers that worry me. There are vehicles here that are operated 24/7 with only one driver paying for the pda the operators don't care and the council don't seem to have time to check records.

Clarification of Deregulation Bill clause

Readers' Letters .

Daily Echo: Clarification of Deregulation Bill clause

“NEW cab bill will put our safety at risk,” says the piece by Rowenna Davis, Labour candidate for Parliament in Southampton Itchen (In My View, August 8).

Totally untrue.

Ms Davis uses the words “cab” and “taxi” in her letter.

The clause in the bill she refers to is private hire not Hackney Carriage.

Only a fully checked licensed driver can drive a taxi. It is against the law for a private hire (licensed or not) to pick up in the street. She also states that police.women’s groups, pensioners and our councillors are worried about assaults and rape etc.

Southampton City Council could allay these worries very simply – remove all logos and advertising from all private hire cars. London private hire have a small sticker in the rear window.

The large private hire companies will say their customers need to know their cars. Rubbish!

A legit driver will have the name and destination.

MIKE TEJADA (Recently retired hackney (taxi ) driver of 20 years, Address supplied.

I wonder just how much out of touch the retired chap is - then realise he's from Southampton
