im getting confused

if i dont take the person on my pda am i insured

yes or no

Technically yes. If you have an accident resulting in a claim, and you have been found guilty of an offence relating to that accident the insurance company can refuse to pay out.

And I suppose (although I've never heard of it happening) that if you get prosecuted for a motoring offence, and found guilty, then that renders your insurance invalid at the time of the offence and thus you could get done for having no insurance !

Actually, thinking about it, you probably are insured but it just means the company won't pay out. :?

The insurance will pay out to 3rd parties but may not pay out on your own vehicle. I knew a chap who drove into a queue of people waiting at a bus stop. He caused loads of injuries that were still being paid out by his insurers years later. He was drunk at the time of the incident.
