The council could issue a license for one month pending the DBS check - if the driver has been licensed before and never created any problem - then what's the issue?

the council are fettering their discretion - they are obviously not treating applications on a case by case basis - each case on its own merits.

It's ars*hole councils like this that the the government should have addressed.

Take the c*nts to court - and get compensation.

His current badge expired last Friday.
I have suggested that he gets it in writing that she has refused his renewal. Also I suggested that he asks her why he is considered to be a "not fit and proper person" Under section 51 of the 1976 LGMP act.

Get him to lodge an immediate appeal to the local magistrate court under the Act. When he wins, apply for compensation.

Id grab the Chair of licensing he/ she should be able to instill some common sense no matter what party its from, certainly quicker than a court action just go round its house.

Not necessarily - the application was presumably made before Friday - it was seemingly refused?

But he didn't say when the forms weren't accepted - he may have gone to the council on Thursday and told they wouldn't renew it.

12. Accordingly, I must deal with the questions raised by the case stated:

(1) Is a Hackney Carriage Licence capable of renewal in the sense envisaged by section 60 Local Government (Miscellaneous Provisions) Act 1976 before the expiration of the one year period prescribed by section 43 Town Police Clauses Act 1847? The answer to that is: "Yes".

(2) Is a Hackney Carriage Licence capable of renewal, in the same way, after the expiration of that one year period? Answer: "Yes". If so, how long after does it cease to be so capable? Answer: "There is no particular period, but as I have indicated it would only be in exceptional circumstances that a delay of more than a few days would be permissible."

(3) If the licence was capable of renewal, ought the applicant to have renewed the Licence in his case? That is not a question of law. It is a question of exercise of discretion and I need not answer it.

The driver couldnt have renewed before the LA issued him with the forms, when was that?

if our LA will renew a licence without sight of the DBS how come yours cant/wont. what happened to uniformity?

The application was made in good time. As stated previously the DBS was completed and posted out on october 1st. His badge was actually made up early last week and left at the reception desk for him to collect when he had his DBS certificate. as far as weather it is a renewal or, because of the expiry of the last badge, a new application, this does not matter in this case because all the paperwork submitted was the same for both, including the medical.

Is the DBS certificate sent to the driver..??
