Wembley minicab driver accused of killing teacher in A40 crash



A frustrated minicab driver from Wembley rammed into the back of a car so hard it ‘folded like a penknife’ and killed the driver during the morning rush hour, a court heard.

Kugannesan Balasubramaniam, 31, of Longley Avenue, allegedly ploughed his Peugeot car into the 1963 MGB convertible roadster at 48mph on the A40 Westway.

Nick Sennett, who had hired the vintage vehicle, suffered serious head injuries as his car was shunted forward violently in the four-car crash on April 16.

The 58-year-old, who taught economics at Latymer Upper School in Hammersmith, died at the scene.

Southwark Crown Court heard Balasubramaniam had just collected a sixth-form student from Heathrow Airport and was taking her to an address in northwest London when the accident occurred.

Mr Bleaney told the court: “Shortly before the collision she noticed the defendant making a mobile phone call, she thinks the phone was put to his ear rather than using a hands-free system but perhaps more importantly she started to pay attention to what was going on in front of her.

“She simply watched as the defendant drove into a car in front.

“The MGB folded like a penknife.”

The force of Balasubramaniam’s ramming also shunted cars ahead of the MGB in the four-car crash, jurors heard.

Balasubramaniam told officers the car pulled suddenly in front of him into his braking distance, the court heard.

A tracking device inside the vehicle recorded the minicab driver was speeding at 48mph on the 40mph road, jurors heard.

He was also overworked, having worked 90 hours in the previous seven days for the cab hire company One to One, it was said.

Balasubramaniam denies a single charge of causing death by dangerous driving.

The trial continues.

Atkinsons Kitchens and Bedrooms (2007) a worker was paralysed after being flung from his van after falling asleep at the wheel. He had been working for 19 hours and the court found that the company’s philosophy and culture had encouraged excessive hours and placed him at risk of such an accident. His employer was found liable for his injuries and ordered to pay damages. This case is a strong reminder to employers of the need to manage occupational road risk. Companies need to be sure that their employees are in a fit condition to drive and have had adequate quality sleep before getting behind the wheel.

Perfectly normal in London's PH cess pit and GUESS what the LPHCA ignore it as of course do TFL and Old Bill, unless of course theres an accident such as this.

I wonder if the company One to One will lose their license and if the Controller who allocated the job will get nicked also as he or she should :?:


Major chauffeur company's with Drivers on PAYE also push Drivers to work these OBSCENE hours, The Labour government were starting to take this issue seriously as was Ken livingstone before Boris got elected. Boris of course and the Con Dem shower couldnt give a flying fekk, wonder if TFL were influenced by TFL Board member Steve Wright MBE and Secretary of the LPHCA :?: :?:

Minicab driver from Wembley ‘was not to blame’ for A40 death crash

A minicab driver from Wembley who killed a teacher when he hit his classic car so hard it ‘folded like a penknife’ was not driving dangerously, a court heard today.

Kugannesan Balasubramaniam, 31, of Longley Avenue, allegedly ploughed his Peugeot van into the back of the 1963 MGB convertible roadster at 48mph on the A40 Westway.

Nick Sennett, who had hired the car, suffered serious head injuries as his vehicle was shunted forward violently in the four-car crash.

The 58-year-old died at the scene.

Sam Robinson, defending said Mr Sennett had changed lanes and pulled just in front of the minicab at the same time the traffic slowed.

He told jurors: “Unfortunately at the point that the MG made the manoeuvre from the middle lane to the outside lane was the point at which the traffic had back up over that hill.

“What was 100 metres of clear road in front of this defendant suddenly became a whole lot less.

“He couldn’t stop, he tried as we all would, the result was a terrible accident.”

“This was an accident, there is no blame.”

Mr Robinson noted the prosecutor Nicholas Bleaney’s assertion that Balasubramaniam had been driving aggressively had ‘disappeared’ in his closing speech.

He said the tracking unit in the car which recorded speed was no more efficient than a ordinary sat nav and dismissed the prosecution case as having ‘no physical evidence’ showing how fast the vehicle was going.

Although the defendant was speeding, he said it was ‘not dangerous if the conditions are right’.

Mr Bleaney said Balasubramaniam, who failed a basic numberplate-reading eye test when officers attended the scene, was over-tired when he was driving and was working to get more cash.

He denies a single charge of causing death by dangerous driving.

The trial continues.

We could and we should, but the facts are he'd worked 90 hours leading up to the accident, failed a standard eye test, was speeding to some extent and the passenger says he was on the phone at the time. It doesn't look good.

Indeed and if you tail end someone its always your fault.

Ive no doubt he will cop some porridge what concerns me more is that the Company involved, the controller all get theirs also ie. The company gets shut down permanently the Controller who gave him the job gets sent down for exactly the same sentence as the driver. ie no less than 7 years i hope! and this would be a MIRACLE TFL now institute rigorous checks on all company' re drivers working time and consider fitting tachos into ALL of Londons Hackney carriages for rest assured that flaming mob do exactly the same as no doubt the NTA will be pleased to confirm #-o #-o .PUBLIC SAFETY WHO GIVE A FEKKK #-o #-o

funnily enough i believe Helen Chapman at TFL 2 assembly members and the Private Hire and courier magazine have all been informed of this case and would i have thought be awaiting the verdict ............................90 hours driving ffs throw away the key for all concerned =D> =D> =D> bang =D> =D> =D> =D> on Trots :D

Wembley minicab driver found guilty of killing former teacher of chef Heston Blumenthal



A minicab driver from Wembley who killed a teacher after smashing into the back of his car has been found guilty of causing his death by careless driving.

Kugannesan Balasubramaniam, 31, Longley Avenue, collided into the classic sports car driven by Nick Sennett so hard it ‘folded like a penknife’ on the A40 Westway.

Mr Sennett, who was 58-year-old and taught economics at Latymer Upper School in Hammersmith, died at the scene on January 15 this year.

Southwark Crown Court heard Balasubramaniam, had been speeding at 48mph on the 40mph road and had worked for 90 hours in the previous seven days for the minicab company One to One.

The short-sighted driver also failed a basic number plate-reading eye test when officers attended the scene.

Balasubramaniam had denied a single charge of causing death by dangerous driving and was convicted by the alternative charge of causing death by careless driving.

He will be sentenced on January 15.

Warning him he faces jail, Judge Jeffrey Pegden QC told Balasubramaniam: “You should understand that the law makes it clear that a custodial sentence is likely but as you are a man of previous good character I order a pre-sentence report for that day.’

Mr Sennett was a former teacher of chef Heston Blumenthal OBE who attended the £15,700-a-year school.

Paying tribute to him shortly after his death, he said: “What made Nick stand out was his very calm, playful banter. He was one of those teachers you could be very comfortable around. He was really lovable, really funny, chilled out.”
