The law will say that even though she may have agreed to sex and actively participated, she was so intoxicated that she is deemed incapable of taking that decision. That, unfortunately for him, makes it rape.



He should have stuck with Pam...no come backs that way.

The point I was making by putting this story up was the authors twisted view.

The minicab driver has no fans, so basically he has no fans to defend him - and secondly the passenger wasn't known to the minicab driver - he spotted she was vulnerable and took advantage, thirdly, Evans will not be at work alone with people, the minicab driver, when he gets out - if he's granted a license, would be.

The differences are huge - but the author wasn't interested.

You didn't put that forward as you analogy.
However, She was picked up and taken to a hotel where it seems that it was arranged for others to join in and 2 of them had intercourse with her. Does this constitute a "gang"? Not for me to say.

A matter for a jury to decide on, there is no official guideline.
