Well it's just latin meaning 'the thing speaks for itself'.

I think it's used mainly in the context of negligence cases, where the action in question is so self-evidently negligent that insead of the claimant having to prove negligence, the defendant has to rebut the presumption of negligence.

Thus a container falls from a lorry onto my car, and I sue for negligence. It's obvious that the haulier has been negligent, so res ipsa loquitur - it's not for me to prove negligence, it's for the haulier to disprove it.

Thus for me, the case against restricted taxi numbers can be summed up in three words - res ipsa loquitur - ie, it's bloody obvious!!

I've got a GCSE in law you know :lol:

Well, you can babble on in words that no one understands, indeed, paragraphs as you normally do, but the bottom line is that "one size dosn't fit all" and in certain circumstances restricted numbers are definately the prefered option.

My most sincere thanks to all who responded (relevently and supportively) to my original post. I am somewhat heartened and feel so very much better as a result of hearing your advice. Thank you all.

However, might it not be a good idea (for those who chose to do so) to avoid replying/responding to topics in a manner which is patently irrelevant to the original post? I do fully acccept that topics can be "hi-jacked" perhaps somewhat inadvertantly and unthinkingly... but this serves no purpose to any of us.

Surely this is a waste of all of our time and detracts from the core purpose of the Forum?

Thanks again... in any case to you all.

Browning...based in Glasgow...and feeling much better for the (relevant) advice received.

you get used to it.... once a couple of them slightly disagree on even the smallest point or reply in a thread it quickly turns in to the usual hadbags at dawn or some how get turned in to a PH Vs HC or restrict Vs delimit argument. :roll:

bullying ? eh ? answer..... get your sorry ass's into the gym and pump some serious iron....
i,m 6'3" and 18.5 stone..and its not a lard ass 18.5st either...
I dont get ANY hassle / bullying or anything like it from anyone...
the mothers look at my fore-arms and biceps, and thats enough...

yeh sure...you get the odd arse coming out of the club @ 2.30am thinking hes friggin superman and can fight the world..but 9/10, his mates get em out of the way.....
only once have i had to er......slap someones hand..er...so to speak :twisted: ..but he did kick the door of my car...BIG NO NO [-X

The problem nowadays is that licensing authorities are using violence on passengers as a means to revoke licenses indefinately. You may be in the right and have just cause but a licensing authority may not see it that way. What they expect is restraint. I know that is sometimes hard to do but it might be better to show a little restraint than have your license taken away.

hi JD....restraint fine but.....would you let some arse kick YOUR door and sit and do nothing ?? dont think so my friend..he got what he deserved...even the cops said so to..he got nicked for it.....he must have FELL over as i opened the door officer :twisted: ...thats what got logged :wink:

Like I said it is very hard not to react and I think most of us have been placed in similar situations like that in past and probably will in the future.

I have been placed In similiar situations myself. However I was just pointing out the change in attitude of some licensing authorities and even the courts in respect of what they might see as retaliation rather than defence?

i get and understand you point.
but one of the lads down here got his car E7 jumped on by a pratt.
the driver got out and thumped him. The pratt banged his head on the pavement and took him 6-8 hours to come round.
thank the lord the bloke did. but the drivers up for either abh or gbh.
if he is convicted he will lose his license and wont be let into america to see his family.
so its not fair having to put up with pratts.
but every thing we do has got to be straight because noone really loves us out there.

browning i also work within glasgow, what i have found is that 99 percent of times if you are open and honest about your area knowledge or lack of it , it helps in a big way, every time you get a punter in thecar and you are unsure of the destination, JUST ASK, very simple,,ask them the way they would like to go. This way you are rights when there is any fare disputes.
Secondly, you get those punters who think they are the end all and be all of knowledge making [edited by admin] comments or expressing world / current views as a matter of fact. I find it funny that when enticed into the conversation further, there lack of knowledge really shows and exposes them for the bullshitters they really are. I on many occasions have sat there debating issues well after the journey is complete, however im cocky enough to charge them the extra ``waiting time`` or debating time,,whichever way u look at it,,lol,,good luck.

I am currently going throught the knowledge and will be going fot my test in the next 4 weeks. I am over 6 foot & weight about 14/15 stone and I am going to deal with them on how they are with myself. If they are being nasty to me they will get it back in return :evil: This was the only worry I had about taking up taxing, but I have decide if they [edited by admin] me off I will [edited by admin] them off. Well its my car & my rules and if you are not happy GTF.
