Being a one man band operator employed by my own company has benefits, especially if the company loses a contract and I claim TUPE under the new incumbent. I got a substantial payout from KCC under TUPE when the company lost the school bus contract a few years ago and the new incumbent refused to take me on under TUPE. Sweet revenge as the new incumbent was KCC's very own bus company who thought they were exempt from TUPE...

Anyone who regularly works for only one company/firm/operator cannot be self employed. I'd disagree with TT's definition though; if you are on a circuit and you have to pick up little Johnny at 8 o'clock, surely it's just like any other booking you get through the office. If you can't take it then someone else should be able to. If I'm ill and can't cover I sub the job to someone else. Not allowed under KCC T&Cs but they're not in the office at 8 o'clock so I can't tell them till after the event. 8)

Now now TT. It is well documented on here that I employ drivers on school contracts. They are on PAYE and get holiday pay. They are paid well in excess of the minimum wage and also in excess of the current living wage.

Well of course Roy if your circuit allows you to come and go as you please your correct, however if they require you to work shifts the proprietor is up the creek.

Very pleased to see your success regarding TUPE =D> way beyond most posters on here's comprehension!

I didn't ignore working time legislation. It doesn't come into play because the drivers are only working part time and never do more than 20 per week.
Oh and on Roys advice we successfully used TUPE to protect the jobs of one of our drivers and escorts a couple of years ago.

Every base in the country hands out school runs and other work daily, you need to get out more Trotty, make your brain cell work for once, a lot of school runs state "needs regular driver" or "no union driver may be used"

(i made that last one up)

I thought under this new procurement thing you could not just pass runs on, unless its sanctioned by the council.
Come to think about it, it was under the procurement thing that I seen it on the council web site
