what does law says
(can a new decision be allowed to be taken on same matter just before pending appeal logged and listed to be heared )

Council facing an appeal and realising they are set to loose in court (appeal against unlawful suspension) then decides 2 working days before the appeal hearing in Magisterate court that ''they now lift the suspension but same time issue a letter to revoke the license'' on same matter and grounds they had suspended the license
and advise the driver (as Magisterate to turn the hearing into preliminary hearing for new appeal against revocation)

urgent and approperiate advise will be appreciated

Since driver has been kept out of work for 3 months now (despite not being charged with any offence) and cant afford to pay barister so is taking on council himself.

Must admit he done great job so far , since made council to ruch to attempt to change their outdated policy as an admission that he was right :P

I'm not sure they can suspend, and then revoke due to Cardiff - Singh.

The judge said the suspension was the final decision and the end of the matter.

The council can't do both.

I'm pretty sure James Button covered this at the NTA conference last year or in Sunderland the previous year - its on the NTA website.

they just did converted suspension to revocation

issed suspension under old practice pre singh driver wnet to appeal in process of file bundle exchange council became aware he relied on latest singh cardiff case and their policy is out dated , they first asked committe to urgently review policy (not passed by cabnet yet and no consultation with trade either )
facing successful challenge without any opertunity provided to listen to accused now have revoked license
and asking him to convert his appeal to appeal against revocation
