Is there any ruling/case law on hackneys working full time in an area they arent licensed in?

full time as in 6 days a week for 6 months

But obviously for Private Hirings only. They can't Rank, Tout or pick up Hails.

I believe that he is asking if any home licensing area can prohibit an out of town Hackney working predominantly as a Private hire in an area where they don't hold a license.

The licensing authority could place a condition on the private hire operators licences prohibiting the operators from using any vehicles that are not licensed by that authority.

It's a good idea but I'm sure it would be challenged on the basis of restraint of trade.

I thought the law recently changed to allow that to happen.

Yes.

B&H say that they will only re-license if the taxi works predominately within the area.

They take the view that if you want to work elsewhere, go get licensed there.

You will have to lodge a complaint with Lichfield Council and it is up to them to decide what action to take. If they do decide to take action and are successful, they can then notify Walsall Council’s Licensing Enforcement department and we would then be able to look at taking the owner of the Hackney Carriage before Committee who can decide if the said owner is a fit and proper person to hold a hackney carriage licence.
